CLERMONT PLANNING BOARD                       
AUGUST 10, 2005

The Clermont Planning Board held its regular meeting on Wednesday, August 10, 2005.  Those members present were Chairman Larry Saulpaugh, Clayton Andrus, Chris Nolan, Amandus Fuchs and Robert Quierolo.  Others present were Sean Miller, Thomas Francescott, Christine Van Ort, Donald Van Wagner, Lisa Menton, Rebecca Sethi, Robert Desmond, Thomas Vondell, Richard Jones, Paul Doherty, Julienne Voll, Phil Gellert, Randy Bloom, Patricia and Robin Daley, Elizabeth Maher, Judith Neary, Elaine Tate, Philip Seymour and Lindsey Scholl from D.F. Wheelers Office. 

Chairman Saulpaugh opened the meeting.  A motion was made by Clayton Andrus, seconded by Chris Nolan to approve the minutes of the July meeting with one correction.  The correction was to add Albert Trezza’s name to those present at the July meeting.  All in favor.  So carried.

A motion was made by Chris Nolan, seconded by Clayton Andrus to close the regular meeting and open the scheduled public hearing of Thomas Vondell to subdivide 5.87 acres into two parcels.  Parcel l – 1.683 acres and Parcel 2 – 4.187 acres on US Route 9.

A motion was made to close the public hearing and open the meeting by Chris Nolan, seconded by Clayton All in favor.  So carried.

A motion was made by Amandus Fuchs to accept the subdivision as adequate. Chris Nolan amended the motion to note that this approval is given for two driveways, so if the applicant or successor interest reverts to a shared driveway, that they go to the building inspector and show proof of a maintenance agreement and shared driveway agreement.  Clayton Andrus seconded the amended motion.  All in favor.  So carried.

A motion was made by Chris Nolan, seconded by Robert Quierolo to close the regular meeting and re-open the public hearing of Randy Bloom to subdivide a twenty one acre section of 169 acres into five building lots from 2.5 acres to 6 acres on Langridge Road.
At the last meeting there were several notations made for the applicant to show on the map, as follows:

The following was addressed at this meeting:

A motion was made by Chris Nolan, seconded by Clayton Andrus to close the public hearing.
A motion was made by Chris Nolan, seconded by Robert Quierolo, that there is no significant adverse environmental impact by this action on the area.
A motion was made by Chris Nolan, seconded by Robert Quierolo, to give preliminary approval of Randy Blooms six lot subdivision, on the condition that the board receives the Town road legal description, driveway cross easements and maintenance agreement and a notation on drainage pattern of driveways is added to the map.

A motion was made by Chris Nolan, seconded by Clayton Andrus to close the regular meeting and re-open the public hearing on the subdivision of Phil Gellert of a ten-acre parcel from a 45-acre parcel on Mill Road.

Upon review of the survey maps submitted it was noted that the topography needs to be verified by surveyor and contours shown at two-foot intervals on map.  Although there was a letter from the Columbia County Board of Health regarding approval for a three bedroom dwelling on the east side of Mill Road, the board is requesting approval of this system to be noted on the survey map, as the letter was not specific as to location.  There is also a question about using the present farm road as a driveway due to the concerns of the Highway Superintendent if a building were to be built on the foundation of the former barn on the north.

A motion was made by Chris Nolan, seconded by Clayton Andrus to continue the public hearing until these issues can be resolved, and to open the regular meeting.

Sean Miller would like to subdivide a parcel on Nevis Road into two lots.  There is a deeded easement from the property to Moore Road but Mr. Miller does not own the fifteen feet, which connects to the 50-foot right of way.  It is only an easement to get to the former farm road.  It was suggested that he might try to purchase property to gain access to Moore Road suitable for a driveway.  Also, he might build a town road to town specifications or a shared driveway on the present site.

Christine Francescott Van Ort and Thomas Francescott would like to subdivide two lots from a parcel of 37 acres on County Route 6 and County Route 33. Parcel 1 is 12.57 acres on County Route 33, which will be retained by Tom Francescott and Lot 2 is 2.7 acres on County Route 6 to be sold. The remaining twenty-two acres with residence will stay in Christine Van Ort’s ownership. They will need Health department approval on the 2.7-acre parcel, a driveway permit from Columbia County and a description of the inlet and outlet of water leaving the pond on the 2.7-acre parcel.  Residences, septic systems and wells should be shown on survey map.

John and Julienne Voll would like to subdivide approximately 17 acres into two parcels, Parcel l – 5.225 acres and Parcel 2 – 11.915 acres on Cedar Hill Road.  They are presently working on the driveway, which lies close to the wetland buffer zone and for which the DEC permit will expire two years from the issue date.  The board will need a copy of the permit, and Dept of Health is needed for second parcel.  Electric utilities existing and proposed, proposed well, septic and house site should all be noted on map. They will need a driveway permit for the second driveway.

Phil Seymour who is proposing a subdivision of approximately 28 acres on the west and east of Nevis Road into 13 lots has submitted revised maps addressing the comments of D.F. Wheeler in his 5/10/05 letter.  Lindsey Scholl of Wheelers office will review same.

Judith Neary who lives on Nevis Road advised the board of ongoing electric problems on Nevis Road, which she has contacted Niagara Mohawk regarding, without much success.
The board advised that that will become part of the review and will be addressed by the developer.  It may be possible to hold a public hearing in October for preliminary approval.

A motion was made by Chris Nolan, seconded by Clayton to adjourn at 10:35 P.M.
