DOG LICENSING

For your first license, visit Mary Helen Shannon, Town Clerk, for a dog tag; renewals can be done by mail. This license is renewable every year and the Dept. of Agriculture & Markets will send out a renewal notice. Puppies are welcome as well - she has doggie treats!

If your dog is four months old or less we can register him and waive the neuter or spay fee because he/she is not yet old enough. If he/she is close to six months old, wait until you have him/her spayed/neutered if that is your plan to do so. All of this affects the cost of the license, which is $2.50 for a spayed/neutered dog, $7.50 for a puppy less than four months old unspayed/unneutered, and $10.50 over six months unspayed/unneutered. You must have proof of rabies vaccination before you can register.

CLERMONT DOG ORDINANCES

SECTION I PURPOSE:

The purpose of this section shall be to preserve the public peace and good order in the Town of Clermont and to contribute to the public welfare and good order of its people by enforcing certain regulations and restrictions on the activities of animals that are consistent with the rights and privileges of the owners of animals and the rights and privileges of other citizens of the Town of Clermont.

SECTION 2: RESTRICTIONS ON ANIMALS AT LARGE.

No person, owing, harboring, or having the control of an animal shall permit such animal

A) to be or run at large in the Town of Clermont elsewhere than on the premises of such person or on other premises with the consent of the owner or lawful occupant of such other premises.

B) to be at any time, on any street, highway, park or public place in the Town of Clermont unless fully controlled by the owner or such other person by means of a rope, leash, halter, bridle or other device.

C) If a dog, to engage in continuous howling or barking for a period of one hour or more outside the interior of the residence of the owner or harborer of said dog. The word "continuous" shall apply if the howling or barking, even though interrupted from time to time, lasts for a period of one hour or more.

SECTION 3. RESTRICTIONS ON DOGS IN ESTABLISHMENTS

No dog shall be taken into any establishment in the Town of Clermont where food or food products are kept for sale if legible signs are displayed at each public entrance to such establishment that the entry of dogs is prohibited; no dog shall be taken upon or permitted in any establishment were food or food products are kept for sale unless such dog is effectively restrained by a rope, leash or other similar device.

SECTION 4. PRESUMPTION OF OWNERSHIP OF DOGS.

The person who last obtained the issuance of a license for a dog, pursuant to the Agriculture and Markets Law, or any such similar law, shall be presumed; for the purposes of this ordinance, to be the owner of such dog.

SECTION 5. DEFINITION.

For the purposes of this ordinance, the word "person" includes an individual, any combination of individuals, or a corporation.

SECTION 6.

The enactment of this ordinance of any prosecution hereunder shall not be deemed to prohibit an action for the recovery of damages by any person aggrieved or to prohibit the recovery of penalties under Section 126 of the Agriculture and Markets Law or prosecution and conviction under any other applicable statute.

SECTION 7:

Nothing in this ordinance shall be deemed to prohibit the hunting of wild birds or animals with the aid of a dog during open seasons

SECTION 8: WARNING NOTICE and-APPEARANCE TICKETS:

The Dog Control Officer or a Peace Officer having reasonable cause to believe that a person has violated this Law shall issue a warning notice if the violation is a first offense. An appearance ticket shall be issued for any subsequent violation. The appearance ticket shall be in the form prescribed by the Town Board, by Resolution, in accordance with the provisions of Section 124 of the Agriculture and Markets Law and this Law. An answer to such appearance ticket shall be made within ten (10) days of the violation by registered mail, return receipt requested, in lieu of a personal appearance on the return date at the- Court and time specified in the appearance ticket, in accordance with Section 124 of the Agriculture and Markets Law and this Law.

SECTION: 9 PENALTIES

Any violation of this ordinance shall be deemed an offense against the same and each offense shall be punishable by a fine of not exceeding $50.00 or imprisonment for not exceeding ten (10) days or both.
