CLERMONT PLANNING BOARD              

NOVEMBER 9 2005

 

The Clermont Planning Board held its regular meeting on Wednesday, November 9, 2005.  Those members present were Chairman Larry Saulpaugh, Chris Nolan, Amandus Fuchs, Robert Quierolo, Aldo Dusman and Garret O'Connor.  Clayton Andrus was absent.  Others present were Dan Wheeler, Engineer for the Town, Albert Trezza, Town Attorney, Robert Desmond, Debra Cole, Les Cole, Elizabeth Mahar, Judith Neary, Richard Sardo for the Acostas, Paul Doherty, Russell Sharp, Andrea Nussinow, Annamarie Lewis, Julienne Voll, Gary Beck, Irving Minkowitz, Manuel Pinho, Susan Rifenburgh, Philip Seymour, Timothy Ross, Engineer for Seymour.

 

Chairman Saulpaugh opened the meeting.  Minutes were distributed to the board members and a motion was made by Garret O'Connor, seconded by Amandus Fuchs to approve the minutes with one correction.  Eliminate ‘and our town engineer’ on page 2, the second to last paragraph.  All in favor.  So carried. 

 

Chris Nolan made a motion, seconded by Aldo Dusman to close the regular meeting and open the public hearing on the subdivision on John and Julienne Voll, Cedar Hill Road of 15 + acres into two parcels for residential use.  Lot l – 5.14 acres with existing residence, Lot 2 – 12 acres.  Mr. Minkowitz, an adjoining landowner was present.  He did not receive the Agriculture Data Statement but he was notified by certified mail about the hearing.  Chris Nolan made a motion; seconded by Garret O'Connor to waive the requirement of receiving the Agriculture Date Statement, as a copy was given to him at this time. He was properly notified by certified mail.   Fees were paid and the following paperwork was received:

·        Driveway permit

·        DEC Wetlands permit

·        Deed

·        Septic system approval

·        Easements for electric and telephone are in deed and show on map ten feet from property line.

·        Short Environmental Assessment form

 

A review of the SEQRA, noting that the DEC permit is for crossing the buffer with driveway, is entered on the form.  A motion was made to declare a negative declaration by Chris Nolan, seconded by Garret O'Connor.  All in favor.  So carried.

Chris Nolan motioned to close the public hearing, seconded by Garret O'Connor.  All in favor.  So carried.

Discussion followed on Mr. Minkowitz concern over the survey line on the west side of the property.  This dispute should be brought up with Ms. Volls’ surveyor, Robert Zimmerman. 

 

The public hearing for the boundary line change of Russell Sharp was opened on a motion made by Chris Nolan, seconded by Garret O'Connor.  Mr. Sharp is subdividing parcels B & C from the larger parcel A.  Parcel A consists of 54.58 acres, and will be reduced by 1.487 acres, Parcel B and 1.816 acres, Parcel C and annexed to adjacent lands of Red Wing Properties.  Mr. Sharp submitted deed descriptions of Parcel B & C, SEQRA application completed and paid fees.  After a review of SEQRA, a motion was made by Mandy Fuchs, seconded by Garret O'Connor, declaring a negative impact by this action.  All in favor.  So carried.  A motion was made to close the public hearing by Chris Nolan, seconded by Garret O'Connor.  All in favor.  So carried.

 

A motion was made to open the public hearing of Ildefonso and Maria Acosta to subdivide approximately 14.466 acres on County Route 2 west of the Roeliff Jansen Kill  into two parcels, Parcel A – 9 acres with existing residence, Parcel B – 5.466 acres for residential use.  The following was submitted:

·        Subdivision application

·        SEQRA application

·        Driveway permit from Columbia County

·        Septic system approval

·        Notices were sent to adjoining landowners

Discussed the setback line for Iroquois gasline and the easement is the encumbrance.  Cannot build in the easement, but the easement line is the setback line.

After review of the SEQRA application, a motion was made by Robert Quierolo, seconded by Aldo Dusman, to declare a negative impact on this action.  All in favor.  So carried.  A motion was made to close the public hearing by Mandy Fuchs, seconded by Robert Quierolo.  All in favor.  So carried.

 

A public hearing was scheduled for Edward Kahle for a boundary line change on property on Route 9, but the applicant did not have sufficient information for the hearing. 

 

A motion was made by Robert Quierolo, seconded by Chris Nolan to open the regular meeting of the Planning Board.

 

Susan and Ronald Rifenburgh, representing The Potts family, are seeking a boundary line change on Banks Lane, to annex approximately one acre to the existing lot of 1.06 acres.  The board requested a letter of representation, survey map of the Potts property.  The fee of $75.00 was paid.

 

Michael Kokas is inquiring about subdividing approximately 6 acres from a parcel of 97 acres more or less on Pleasantvale Road.  The board requested a percolation test,

driveway permit and survey showing the locations of well and septic on the Robertson property.  An engineer can perform the percolation test if the County Engineer will approve it, since the County is not doing percolation tests for the winter months.  Mr. Kokas paid the fee of $125.00.

 

Manual Pinho brought in survey maps, which were drawn several years ago but evidently never stamped and never filed with the County Clerk.  This was the 12-acre parcel with the ten-unit apartment house on Route 9.  Chairman Saulpaugh will review the maps and if there are no discrepancies he will stamp them.  Mr. Pinho was asking about his approvals for the auto repair shop.  They will expire after one year, if they are not acted on.

 

Gary Beck, Z3 Consultants for the project on Cemetery Road has the completed traffic study.  The trees on the corner of Cemetery Road appear to be on the State right of way, however, the state has maintained that they are on the property owner’s land, so they are unable to eliminate them.  The discussion focused on the proposed easterly exit onto Cemetery Road from the subdivision.  It was suggested that no monument or impediment could be installed and no left-hand turn into the planned road on the easterly access could be made, due to sight line issues.  Mr. Beck thought a ‘no left turn’ would serve the purpose, but the board believes people will not heed the sign.  Dan Wheeler, citing concerns with the road, suggested that they justify the site line distance or seek a waiver for site distance problem.  Our highway superintendent is concerned about an impediment, such as curbing, due to operational concerns of the department.  It is the applicant’s responsibility to talk to State DOT regarding the Cemetery Road/Route 9G site distance issue.  The traffic study was performed during the following hours, Thursday, September 29th and Friday, September 30 6:30 – 9:30 AM and 4:30 – 6:30 PM.  Peak hours are deemed to be 7:15 – 8:15 AM and 4:40 – 5:30 PM.

 

A motion was made by Chris Nolan, seconded by Mandy Fuchs to re-open the public hearing of Philip Seymour on the thirteen-lot subdivision on Nevis Road, which had been continued from a previous meeting.  Discussed the various soil types on the property, topsoil, silty loam.  They have dug the test holes for the percolation tests. Other topics discussed were:

·        Culverts will be flush with grade; flow equal to or less than it was is the desirable.

·        The culvert on Lot 8 and Lot 10 must be lowered which flows under Nevis Road. 

·        Easements for all drainage structures must be shown on plan. 

·        Homeowners association for maintenance or drainage structures. 

·        Table for required drainage maintenance structures. 

·        Extend swales west side of Nevis Road.

·        Grade Lot 8 to drain

·        Lots 1,2,3 and 6 drains to Lot 2 check dam

·        Lots 4,5,7,8,9,10,11,12 and 13 to check dam on Lot 10

·        Shared driveway requirements where required

A motion was made to continue the public hearing by Chris Nolan, seconded by Garret O'Connor.  All in favor.  So carried.

 

The following decisions were made on the public hearing held at tonight’s meeting:

 

Mandy Fuchs made a motion, seconded by Garret O'Connor to accept the Julienne and John Voll subdivision as presented.  All in favor. So carried.

 

Mandy Fuchs made a motion, seconded by Aldo Dusman to accept the Russell Sharp boundary line change as presented.  All in favor.  So carried.

 

Garret O'Connor made a motion, seconded by Chris Nolan to accept the Ildefonso and Maria Acosta subdivision as presented.  All in favor.  So carried.

 

Dan Wheeler spoke on Phase II Stormwater, etc.

 

A seminar on Amending and Changing Zoning will be held at Columbia Greene Community College on Tuesday, December 6 from 6:30 P.M. to 8:45 P.M.

 

Garret O'Connor made a motion, seconded by Chris Nolan that Chairman Saulpaugh stamp Manuel Pinho maps after checking with the Columbia County Clerk.  All in favor.  So carried.

 

A motion was made to adjourn by Garret O'Connor, seconded by Robert Quierolo.  All in favor.  So carried.
