CLERMONT PLANNING BOARD
DECEMBER 10, 2014
The Clermont Planning Board held its regular meeting on Wednesday, December 10, 2014 at 7:00 P.M. Those in attendance were Chairman Laurence Saulpaugh, Thomas Jantzen, Mary Howard, Jennifer Phillips and Clayton Andrus. Aldo Dusman and Robert Queirolo were absent. Others present were Patrick Prendergast, Ray Tousey, Robert Ihlenburg, Lyle Wasylchak, Catherine Spencer, Robert Desmond, Nan Leonard, Maureen DeKaser, Andy Howard, Town Attorney and George Schmitt, Town Engineer.
IRISH HILLS, LLC./RED WING PROPERTIES: Paul Doherty - Elizaville Spring Lake Road – Tax Map ID#201.00-1-71, 69 and 76: Robert Ihlenburg, Surveyor presented the proposal to the Board for Mr. Doherty. There are three tax parcels, Tax Map #201-1-69 with house and barns, Tax Map #201-1-76, easement for power line, Tax Map ID#201-1-71, vacant land. The applicant would like to subdivide into two lots, l9.9 acres with road frontage with house and barns, and the other parcel totaling 62 acres.
The power line easement belongs to Red Wing Properties and part of that is with the 19.9 acres. There was discussion about the l00 foot road frontage and whether or not he would be able to subdivide the 62-acre parcel at a later date. If he wants to get the perc tests done on the 62-acre parcel otherwise they will be Non Health Department approved. A public hearing will be scheduled for January 14, 2015 at 7:30 P.M. The applicant to notify adjoining landowners.
CATHERINE SPENCER: 164 Shields Road – Ms. Spencer appeared in front of the board regarding the turn-a-round on the property next door, which does go onto her property for 2.65 feet. This is creating a problem for her to build her garage. The owners of the property next door would remove the turnaround if she will sign an agreement. The neighbor asked that the planning board remove the easement, but our attorney leaves it up to the neighbors. The board is not authorized to abandon it. If the landowners desire to remove it then they can. Ms. Spencer also said that vehicles turn around across the street and cross her driveway in the process and create ruts and mud. It was suggested that putting a chain across her driveway would prevent this.
Our attorney, Andy Howard, suggested that she check with her attorney before signing any agreement but that this is an issue between the parties involved.
RAY TOUSEY: 1783 Route 9 – Tax Map ID#181.3-1-6.110
Mr. Prendergast presented the revisions that have been made to the Tousey plan for use of the existing barn for a meeting hall/convention center. They have detailed handicap parking; lighting is shown with pole lamps, 500 watts, changes for DOT entrance by cutting back blacktop and sawcut at the white line. This application went in front of the County Planning Board for review. They have responded with their concerns regarding proposed and future water supply, electric supply/utilities, access, solid waste, fire safety, lighting and emergency access.
Asked about garbage disposal, it was stated that garbage cans would be on the backside of building. Mary Howard suggested an enclosure for the garbage cans. Stairs for fire escape will be at the rear of building and appears to have enough room.
Tom Jantzen asked about temporary lights. He thinks that they should be up on a pole and he doesn’t believe that the type of lights shown is good for an exterior light. George Schmitt, our engineer is concerned if the lights are building code compliant. They may be compliant for inside work but not for a field. The applicant will review the type of lighting.
Jennifer Phillips thought that we had come to an agreement last month that events would end at 10:30 P.M. on weekends so that must be changed on proposed resolution. On the electric supply, the building dept. makes the determination.
Maureen DeKaser, neighbor, would not want a permanent tent on the site for the whole season as has been mentioned. She also asked if open from April to November will there be heat in the building or the tent. There will be no generators for heating. It doesn’t show where the catering trucks will be parked and she has concern about the noise. She has some concern over sanitation at this site. Ray does not foresee any big trucks making a lot of noise. Lyle Wasylchak has concerns about vendor tents but those would only be up for a few hours and then gone.
Jennifer Phillips thinks that is the concern about the tent becoming a permanent structure.
There was further discussion about tents and that it should be a temporary tent.
Tom Jantzen asked about the use of the tent. Jennifer has more concern about the sound from under tent and all events are supposed to be inside. Tom Jantzen would like to limit what can be done in the tent. All amplified sound shall be in the meeting hall structure.
It should be specified that the tent is temporary, not necessarily the use. The tent location on site plan shall be temporary in nature to be taken down when not in use.
Maureen would like some sort of dense thick foliage so that she doesn’t have to view a parking lot. Mary Howard suggested forsythias, which become dense and grow tall along the fence line.
Andy Howard came up with language for the pop up tents which are 10 X 10 in size. He would caution about limiting the number of tents and not restricting to where the tents can be set up.
There was further discussion on the lighting. There will be lights on the building, which may be sufficient to shine on the parking lot as opposed to poles in the parking lot, which may annoy the neighbors. Andy Howard said that most large venues do not have lighting in the parking lots, that lights from other vehicles are usually sufficient.
A motion was made by Mary Howard to close the public hearing on the Tousey site plan application, seconded by Clayton Andrus. All in favor. So carried.
MINUTES: A motion was made by Jennifer Phillips to approve the minutes of November’s meeting, seconded by Tom Jantzen. All in favor. So carried.
Chairman Saulpaugh went through the Environmental Assessment form and a motion was made by Jennifer Phillips, seconded by Clayton to declare a negative declaration
RESOLUTION:
Mary Howard would like to change #3 - events to be held April l to November 30. Jennifer Phillips asked if we all agree on the hours as in the proposed resolution for amplified sound Sunday through Thursday until 9:00 P.M; on Friday or Saturday none beyond 10:30 P.M.
(6) All amplified sound should be sited within the building.
(7) The tent shall be temporary and used on an event by event basis.
(8) 10 x 10 -Pop up tents may be utilized and taken down each day.
(9) Screening with 10 – 5 gallon pails of forsythia plants, ten feet apart along the northwest corner to provide screening of parking area.
Andy does not want to be explicit about the lighting. He will leave it to the applicant.
He will add that the lighting should be a temporary, weatherproof rated lighting for the parking lot if the applicant chooses to utilize it.
The board could vote to approve the resolution tonight with corrections as discussed.
A motion was made to approve the resolution as modified by Clayton Andrus, seconded by Jennifer Phillips. All in favor. So carried.
A motion was made to adjourn by Mary Howard, seconded by Jennifer Phillips at 9:35 P.M. All in favor. So carried.
