CLERMONT PLANNING BOARD
APRIL 8, 2015
The Clermont Planning Board held its regular meeting on Wednesday, April 8, 2015 at 7:30 P.M. Those in attendance were Chairman Laurence Saulpaugh, Clayton Andrus,
Thomas Jantzen, Mary Howard, Jennifer Phillips, Nathan Hempel and Ronald Miller.
Also present were Robert Desmond, Hart Perry, Ripley Hathaway, Harold Rockefeller, Mark Graminski, Jessica Vigars, Colin Fazio, Kevin Hilbert, Maureen Barca, Ralph Arlyck, Mark Hearndon, George Schmitt, Engineer for the Town and Mark Griesemer, Attorney for the Town.
A motion was made to accept the minutes of the March meeting by Thomas Jantzen, seconded by Clayton Andrus. All in favor. So carried.
A motion was made to close the regular meeting and open the public hearings, seconded by Thomas Jantzen. All in favor. So carried.
PUBLIC HEARINGS:
RANDY BLOOM: In Bloom Properties – 78 Langridge Road – Tax Map ID#200-l-26.11 Ms. Bloom was represented by Mark Graminski, Engineer/Surveyor for a subdivision of 48.50 acres into two lots, Lot 1 – 11.341 acres with existing residence and Lot 1B – 37.159 acres vacant land. The certified return receipts of notification were received. Mr.Graminski has shown the location of existing well and septic for Lot 1A and the proposed location of the well and septic on Lot 1B. The Department of Health came to site and looked at test sites. He has met with the highway Superintendent and got driveway approval. There are some trees, which have to be removed for site distance. The box culvert has been raised and reduced the grade off Langridge Road to 9% and 8% in the other direction. Spoke with our engineer about the curve to make sure it was appropriate for emergency vehicles and larger vehicles, which it is. George agrees with the changes. Mark did not check with the fire department, but he will. He does not have anything from the health department. He will meet with them in the next few weeks. The electric is in the ground. Michael Hearndon was present and viewed the map. His property is north of the proposal.
A motion was made by Clayton Andrus, seconded by Mary Howard to close the public hearing and open the regular meeting. All in favor. So carried.
The Chairman reviewed the SEQRA Part 2 – A motion was made to declare a negative declaration by Mary Howard, seconded by Tom Jantzen. All in favor. So carried.
Mary Howard made a motion to conditionally approve the subdivision, seconded by Tom Jantzen. Once the septic systems are noted on the map and approved by the Dept of Health and contact is made with the Fire Chief, the maps can be stamped. All in favor. So carried.
A motion was made by Clayton Andrus to close the regular meeting and open public hearing on the application of Ralph Arlyck, seconded by Mary Howard. All in favor. So carried.
RALPH ARLYCK: 122 Old Road – Tax Map ID#1990-1-36 Application for Ground Mounted Solar System There will be three pedestals and 45 arrays and will be approximately 40 feet from the north property line. Maureen Barca, a neighbor, is not opposed to solar panels but is concerned about where they are located. She has not seen where they are going to be located; however, the location is shown on the map. Also, she asked for appropriate screening, such as forsythia, to avoid interfering with view shed. Mr. Arylyck would be happy to do some screening. Clayton Andrus asked if she would be happy with forsythia because it looses cover in winter. Tom Jantzen suggested a combination of forsythia and something for winter cover might be suitable. The board noted that there is a 75-foot minimum front yard setback and 50-foot minimum side yard setback in the RLB3 zone. Presently it does not appear that what is shown have met these requirements. If they cannot be moved he would need a variance for the 75 feet from the road, 50 feet from the side yard. Kevin Hilbert, a neighbor, asked if they could be staggered more. Bob Desmond suggested screening from Route 9G. Mr. Arlyck wondered if they need to be completely hidden from everyone’s few, since these are becoming more common place.
The board asked that Mr. Arlyck show the actual measurements on the map that there is 75 feet from the road and 50 feet from the side yard and show screening on the map also.
Also need stamped certification from Solar Generation, Inc. A motion was made to continue the public hearing until next month by Clayton Andrus, seconded by Tom Jantzen. All in favor. So carried.
HAROLD ROCKEFELLER: 441 County Route 6 – Tax Map ID#190-1-15,11
Mr. Rockefeller proposes subdividing 2.50 acres from 160.7 acres. This property extends on both sides of County Route 6 and as such makes it two parcels naturally subdivided by the road. The north side of the road is approximately 30 acres and the division of 2.50 acres from that parcel will result in two remaining lots, 23 acres more or less and 7 acres more or less. Matthew and George said that the map should show the entire property and descriptions on each lot. This will be considered a two-lot subdivision. Locations of existing wells and septic should also be shown on adjacent properties. Fees were paid for two lots.
HART PERRY – Southwood Property - 726 Woods Road – Tax Map ID#179-1-33 - Site Plan Application/Special Permit for special event use.
Mr. Perry explained that there have been events and weddings on the property over the last 40 years and he was unaware that he needed a permit. There are 86 acres and the events are held on the property. The maximum number of events would not exceed 8 to 10 per season. There would be between 22 and 150 people at the events. There is a contract with those using the service and they provide port-o-toilets, insurance and caterers. The Harts provide the property. George Schmitt, our engineer, said this should go on the application that there is no water or wastewater use, or it would have to go through the Board of Health. There is handicap parking shown on the map but the map should show more detail of the parking. The board requested a site plan prepared by an engineer and a copy of the contract.
RIPLEY HATHAWAY – 930 Woods Road – Tax Map ID#168-1-1 - Site Plan Application/Special Permit for special events use.
Ms. Hathaway has Engineer Tim Ross and he will be talking to DOH regarding water usage and septic. She explained that the road into her property is 20 feet wide. There is a 96 x 92 turnaround at the barn. She holds 12-16 event per year with a maximum number of 300 people. There is no music after 10:30 P.M. The board asked that she give the period of time that events are held, show handicap parking and parking in detail.
She will have Tim Ross prepare her plan.
Thomas Jantzen recused himself from the following discussion.
ALFRED JANTZEN: Cedar Hill Farm-137 Mountain View Road – Tax Map ID#192-1-29.1 & 201-1-01 for Cell Tower. NYNEX Mobile Limited Partnership 2 d/b/a Verizon Wireless represented by Jessica Vigars, Esquire of Young, Sommer, LLC and Colin Fazio, Sire Acquisition Specialist for Pyramid Network Services appeared with Mr. Jantzen. The ZBA forwarded the special permit application and the applicant submitted a site plan application for the Planning Board. The property is 297 acre parcel and this use would involve 1.67 acres approximately. The tower would provide service to the areas of Route 9, County Route 6 and County Route 80 where there is a coverage gap. The cell tower is a 120-foot monopole tower. There is an easement from Pleasantvale Road to the access site. The lease area is setback from the road. The access road will be gravel and will not have access by the public. The wetlands are federal and will be delineated.
Jennifer Phillips asked if we need details on the construction process such as erosion control. The full Environmental Assessment form and visual EAF is in tab 4 of the handout. Mary Howard asked about the amount of gravel being moved or brought in, and if there is a certain amount being brought in a permit is needed. The tower height is determined by a few factors. The tree canopy is approximately 80 feet and this tower can provide service from other carriers. The board would need a landscape plan. The property line is 201 feet from the designated tower area and over 1000 feet on the other side.
Larry asked about abandonment of the tower due to aging, etc. There are specifics in the zoning which address this. The ZBA and Planning Board will determine whether or not to hold joint meetings on this application.
