OCTOBER 8, 2008
The Clermont Planning Board held its regular meeting on Wednesday, October 8, 2008 at 7:30 P.M. at the Town Hall. Those present were Chairman Laurence Saulpaugh, Clayton Andrus, Aldo Dusman, Garret O'Connor and Thomas Jantzen. Nancy Sperry and Robert Queirolo were absent. Also present was Jay Trapp of D. F. Wheeler Engineers, Joyce and Jim Shaw, Family Sweets and Andrew Howard, Town Attorney.
Chairman Saulpaugh opened the meeting. Garret O'Connor motioned to accept the minutes of the September meeting, seconded by Clayton Andrus. All in favor. So carried.
JOYCE AND JIM SHAW - Family Sweets - County Route 6 and Route 9
The Shaws have applied for site plan approval for a retail/wholesale store in the Clermont Hamlet at the corner of County Route 6 and Route 9. At previous meetings they were asked to provide documentation from the Department of Transportation that they were contacted regarding the use of the front of the store on Route 9 for parking/egress and ingress. They were also asked to seek approval from the Columbia County Public Works regarding the same in the rear of the store. The Shaw's did get a letter from DOT which states that there should be no parking or access in the area in front of the store due to the close proximity of the intersection. The paved area in the front should be blocked off on a more permanent basis using something like half barrel planters or the like. The Columbia County DPW responded that as shown on the sketch, there is adequate room for cars to back out of their parking area and turn without having to back onto County Route 6.
The Shaw's have put up planters in front of the store set on blocks to deter anyone from pulling in close to the building. They stated that DOT does not want a permanent marker or fence in the front because of the hazard. Their site plan provides for a handicap parking space 20' x 20'. It provides for two additional parking spaces 9' x 20' for a total of 1880 square feet of parking and turning area. Aldo Dusman asked what is going to prevent people from backing into Route 6. The Shaw's response is that nothing other than having the police sit there all day. The County has addressed the issue of backing into Route 6 by determining that there is adequate room for cars to back out of the parking stall without backing onto County Route 6.
Andrew Howard asked the size of the store. The store area is 453.87 square feet. He checked the code requirement for parking vs. the gross square foot area, and with the 40-foot depth, they have doubled the required depth. This makes it possible to backup and back around a car that is already parked. This meets the minimum requirements and doubles the length of what is required by code. They meet the space requirements. Chairman Saulpaugh suggested putting up a sign that states do not back out onto highway. This should cover you because you have notified them.
The requirements for site plan review state that we shall have a public hearing. A motion was made by Clayton Andrus to accept the site plan, seconded by Garret O'Connor. All in favor. So carried.
A public hearing will be noticed for Wednesday, November 12, 2008 at 7:30 P.M. The applicants were notified to send or hand deliver certified return receipt letters to the adjoining landowners within 200 feet of the store. The sending of the Agricultural Data Statement was waived.
Mr. Howard reported on the Ackerman Subdivision and what is going to take place. The money to complete the road is to be put in escrow. Our engineer, Ray Jurkowski will complete the inspection and certify to it in order that the road can be dedicated to the Town. Mr. Ackerman will also complete some other drainage issues that the residents have asked for.
A motion was made to adjourn at 8:30 P.M. by Garret O'Connor, seconded by Clayton Andrus.
