CLERMONT PLANNING BOARD
AUGUST 12, 2015
The Clermont Planning Board held their regular meeting on Wednesday, August 12, 2015 at 7:30 P.M. Those in attendance were Chairman Laurence Saulpaugh, Mary Howard, Thomas Jantzen, Ronald Miller, Nathan Hempel and Clayton Andrus. Jennifer Phillips was absent. Others present were George Schmitt, Town Engineer, Matthew Griesemer, Town Attorney, Harold Rockefeller, Ripley Hathaway, Ken Dow, Attorney for Ms.Hathaway, Colin Fazio and Jessica Vigars for Verizon, Alfred Jantzen, Rich Carney representing Mr. Perry, Members of the Zoning Board of Appeals present were Tami Connolly, Secretary, Chairman Hank Himelright, Luke Kumburis, John Rusconi, Peter Cichetti and Luke Kumburis.
A motion was made to approve the minutes of the July meeting by Tom Jantzen, seconded by Clayton Andrus. All in favor. So carried.
PUBLIC HEARINGS: The following public hearings were held jointly by the Planning Board and the Zoning Board of Appeals. Motions were made to continue the public hearing by the ZBA on the Hathaway application and to open the hearing by the Planning Board.
RIPLEY HATHAWAY: Northwood Farms, 930 Woods Road, Tax Map ID#168-1-1
Attorney for Ms. Hathaway, Ken Dow told the board that the final configuration from the Health department would be completed based on the approval from the boards.
The applicant has received County highway approval. Peter Cichetti of the ZBA did do a site inspection. He feels that the roadway is adequate. The septic system is inadequate but will be done once approved. Don VanWagner, ZBA, said there is another access for the fire trucks which can come in from behind. There was no one present for or against this application. Ms. Hathaway did submit the certified return receipts of mailing.
A motion was made to close the public hearing on Northwood Farms by Luke Kumburis, seconded by Donald Van Wagner. All in favor. So carried.
A motion was made to close the public hearing by Mary Howard, seconded by Tom Jantzen. All in favor. So carried.
HART PERRY: Southwood Properties, 726 Woods Road, Tax Map ID#179-1-33
A motion was made to open the public hearing for Hart Perry by Mary Howard, seconded by Clayton Andrus. All in favor. So carried.
Zoning Board members have been at the site and determined that there is a very steep slope on the riverside. Mr. Perry had agreed to put up a fence, something of substance even if it is removable. Peter said to make sure the road is maintained for fire trucks due to low hanging tree limbs. Also, it is narrow going through the second row of pillars on the driveway because of shrubbery. There was no one present for or against this application.
A motion was made to close the public hearing by Don Van Wagner, seconded by Luke Kumburis. All in favor. So carried. If the board views it as a safety issue the SEQRA could be done after the fence is added to the map. Chairman Himelright thinks that he could do a temporary fence as long as it is sound and the building inspector goes along with that.
A motion was made to close the public hearing by Tom Jantzen, seconded by Ron Miller. All in favor. So carried.
A motion was made to approve the application of Ripley Hathaway conditioned on approval by the Health Department by Mary Howard, seconded by Tom Jantzen. All in favor. So carried.

A motion was made to approve the application of Hart Perry conditioned on the addition of fencing on the property on the river side of the event area by Don Van Wagner, seconded by Luke Kumburis. All in favor. So carried.
A motion was made to approve the application of Hart Perry condition on the addition of fencing, as stated above by Mary Howard, seconded by Tom Jantzen. All in favor. So carried.
SEQRA REVIEW:
A review of the long form SEQRA was done on the application of Ripley Hathaway and Hart Perry and a motion was made by Clayton Andrus to declare a negative declaration, seconded by Tom Jantzen. All in favor. So carried.
HAROLD ROCKEFELLER: 441 County Route 6, Tax Map ID#190.00-01-15.11
Mr. Rockefeller would like to do a boundary line change, removing 1 acre from a parcel of 129.70 acres and annexing to lands of Steven Bonner, Tax Map ID#190.00-01-12 increasing his parcel to 2.20 acres,
A public hearing will be scheduled for Wednesday, September 9, 2015 at 7:30 P.M.
VERIZON WIRELESS/ALFRED JANTZEN: 137 Pleasantvale Road, Tax Map ID#192-1-29.1 and 201-1-01.
Mr. Jessica Vigars and Mr. Colin Fazio representing Verizon Wireless submitted additional information including pictures from the balloon test held on July 21st. The photos showed the heights of the proposed tower at 120, 140 and 160 feet. The location of the test was moved 100 feet south of where the actual tower will be because of the cover conditions. Several of the board members present were at the site of the balloon test as were members of the public. At the public hearing if there are any outstanding issues, there will be consultants available to discuss any concerns. She feels that there is very minimal visual impact because the site is far off the road and there is substantial tree cover. They are planning to add a double swing gate in two places, as was discussed previously, with tall security fencing and a gate around the compound. A combination for locks is provided to emergency personnel. Verizon's trucks will do there own plowing.
Ms. Vigars requested that the application be deemed complete. The comments made in our engineer’s letter of 8/12/15 will be addressed before the public hearing.
A motion was made to deem the Verizon application complete by Ron Miller, seconded by Nathan Hempel and to schedule the public hearing for September 9, 2015 at 7:30 P.M with the Planning Board and the Zoning Board. All in favor. So carried.
A motion was made to adjourn by Mary Howard, seconded by Clayton Andrus at 9:15 P.M.
