CLERMONT TOWN BOARD
PUBLIC HEARING
OCTOBER 5, 2015
The Clermont Town Board held a public hearing on Monday, October 5, 2015 at 6:30 P.M. at the Town Hall. Those present were Supervisor Raymond Staats, Councilman Robert Desmond, Councilwoman Dawn Brownson, Councilman Evan Hempel and Councilman Kris Gildersleeve. Others present were Andy Howard, Town Attorney and three residents.
The Town Clerk read the public notice which states that the purpose of this hearing is to conduct an inquiry and balancing of the factors to be weighed under Matter of Monroe, 72 N.Y. 2d 338 (1988) on whether the Town of Clermont is subject to zoning and land use approval by the Town Planning Board with regard to the proposed Highway garage equipment shed.
A motion was made by Councilman Desmond to open the hearing, seconded by Councilman Gildersleeve. All in favor. So carried.
The purpose of this public hearing is to discuss the new highway storage shed to be constructed by the garage. Andy Howard, our attorney explained that this is a storage facility for use by town highway department.
The Town Board is primarily responsible for legislative and executive functions of the town. The pole barn is of a non-propriety nature for the Town Highway department and for the benefit of the Town. The building is on the town property and the creation of the pole barn is the minimal, the alternative would be to construct a larger facility.
The purpose of this public hearing is for everyone to be heard.
Councilman Desmond stated that this will allow us to cover some equipment that has been stored outside and remove an eyesore from public view.
Public comment:
Mr. Finta asked if we have always used the Matter of Monroe or is it for expediency.
Supervisor Staats explained that the Town board and Planning Board are both the same kind of agencies and there is no reason to go back to the Planning Board for something that we will abide by. Councilman Desmond commented that we have gone to the Planning Board and ZBA for a variance and lot line adjustment, which involved another governmental agency also.
There were no other comments or discussions.
The full environmental assessment form, Part I was completed by our town engineer. Andy Howard, our Attorney, read through Part 2 and the board responded. This is classified as an unlisted action.
After review of Part 2, a motion was made that there were no negative effects by this action and declared a negative declaration by Councilman Desmond, seconded by Councilman Gildersleeve. All in favor. So carried.
A motion was made to close the public hearing at 6:45 P.M. by Councilman Desmond, seconded by Councilman Gildersleeve. All in favor. So carried.
