ZONING BOARD OF APPEALS
JANUARY 27, 2016
The Clermont Zoning Board of Appeals held their regular meeting on Wednesday, January 27, 2016 at 7:30 P.M. at the Town Hall. Those in attendance were Chairman Hank Himelright, Donald VanWagner, Phyllis Heiko, Luke Kumburis, John Rusconi and Peter Cichetti.
Others present were Kurt Andernach, Kenny Krapf, Hart Perry and Robert Desmond.
The Chairman opened the meeting with the salute to the flag.
A motion was made by Don VanWagner to accept the October minutes, seconded by Peter Cichetti. All in favor. So carried.
An application was received from Adrian Robert DelValle and Caroline Gardner to extend the roofline over the entranceway. James Bates was representing them but was not present, neither were the applicants. Since the application was received, the deed has been received but payment of the fee has not been received.
Chris Gilbert has not submitted an application, which was discussed with the board. Chairman Himelright has done a site visit.
ANNE K. SPIESS: 356 County Route 6 Tax Map ID# 179-1-48 – 108.40 acres
Representing Ms. Spiess was Kurt Andernach of andernachconcepts and Kenny Krapf for an application for a wedding venue on the County Route 6 property. The application was submitted along with five copies of the plan, deed and water test results. County Highway approval has not been approved for a commercial highway permit, where there is a private drive now. They have information on the septic but no engineer’ drawings. The application fee and escrow have been paid. Mr. Andernach explained that the horse arena and utility building would be used. They have laid out parking spaces and handicapped parking areas. The roof on one of the buildings would be extended eight feet to create an open porch for receptions. There are adequate bathrooms, a kitchen prep area and storage area. There would be no modifications to the main building. Phyllis Heiko asked what the floor would be, but this has not been decided whether it will be cement or wood.
The existing well is sufficient. The septic system will be a 4000 gal tank with pump chamber, 22 runs of 100 feet and a 135’ x 105’ leach field. Kenny Krapf said that the health department would accept an engineer's stamped design for the septic. Mr. Andernach was asked to identify the farm operations within 500 feet on the Agricultural Data Statement. The application was deemed complete for a special use permit contingent on Planning Board site plan review and meeting the specifications. At the next meeting we might do a site visit.
A motion was made to accept the application contingent on Planning Board site plan review and specifications by Peter Cichetti, seconded by Luke Kumburis. All in favor. So carried.
HART PERRY: Southwood Properties, 726 Woods Road, Tax Map ID#179-1-33
Mr. Perry has been thinking of a possible subdivision of his property on Woods Road.
There are several buildings on the property, main house, caretaker’s house and kennel house, as well as barns and sheds. He would probably divide the property with the main house, caretaker’s house and kennel house and build a house for his family on the remaining property. This could be a sale or lease.
The zoning allows for 50 feet for a driveway for each residence.
The planning board would have to make this decision. Mr. Perry was told to prepare a preliminary sketch plan and attend their meeting. The applicant may want to get an attorney and an engineer.
There was discussion about other possible wedding venues taking place without the proper permits. This will be looked into.
Phyllis Heiko asked what are the rules about having a tractor-trailer in your yard. In the zoning, there are no regulations about commercial vehicles on your property.
Peter Cichetti is going to apply for a wedding venue. He will be in next month.
A motion was made by Don VanWagner to adjourn at 8:30 P.M., seconded by John Rusconi. All in favor. So carried.
