Clermont Zoning Board of Appeals

Regular meeting: March 23, 2016
Members attending: Hank, Don, John, Luke, Peter, Phyllis and TamiHank opens the meeting at 7:30 pm.
Hank asks for a motion to accept the minutes as presented if there are no errors. Don makes a motion and John seconds the motion. All are in favor and the motion is carried.
Hank reiterates that the application for Chris Gilbert was discussed but not accepted and was given back to Chris.
Old Business:Chris Gilbert is here to apply for an area variance. He has copies of his property survey. Chris passes out the application that he is presenting. There is 13.6 feet between the silo and the carriage house. The variance could go on the silo side for a 6 foot variance. This is what Hank is proposing. This was done under subdivision of the original owner. There will need to be a re-survey. If and when this application is accepted, it would need to go to county planning and the ZBA will need a recommendation from the Clermont Planning Board. The board should not be creating two non-conforming lots. Chris states to the board that there is no one living in the silos. Pete suggests that the second lot with the silos be non-sub dividable. The amount of road frontage is discussed. Chris explains that the barn was the office. This was a grain office. John is looking over what the road frontage would be if the subdivision goes through. Hank states that if it were to go through, one parcel would be in conformance (the one with the house and carriage house). Pete asks if the maps are going to be accepted as presented. Hank states a new map will need to be presented with corrections of lot lines, mark where well and septic are along with the application at the next meeting to be further reviewed for completeness and to vote on it being accepted or not at that point. Hank wants the board to provide feedback on this application. Chris can have the property re-surveyed and then at the next meeting he can present the new map and the application. If it is accepted, a public hearing can be scheduled and the process can start with the County Planning board and the recommendation from the Town planning board. The next regular meeting of the ZBA is April 24th at 7:30 pm. The application was reviewed, but has NOT been accepted. There was just board discussion with the applicant. Bob Desmond states that the property has multiple uses on a single lot and that is not in compliance. The shop is one use, the art studio, the music studio, the tile storage and cabinet maker storage. Bob points out that there should be one use on a parcel. Chris feels that he is in compliance. Bob states that to be granted a permit/variance, you must not be in violation. It would be up to the ZEO and/or the Zoning board to interpret that. The large building in the back is a cabinet shop. If there is an existing violation, the board is not supposed to grant anything until the property is in compliance. Is this grandfathered in, is the question. The board states no. The details would need to be ironed out and discussed between the boards. Bob states that a condition of the variance could be added if granted.
New Business:There is a class upcoming on map reading. It is limited to 20 people.Hank asks if there is any other business. There is none. Pete makes a motion to close the meeting. Luke second and all are in favor. The meeting is adjourned at 8:30 pm.
