CLERMONT ZONING BOARD OF APPEALS
APRIL 27, 2016
The Clermont Zoning Board of Appeals met on Wednesday, April 27, 2016 at 7:30 P.M. Present were Chairman Hank Himelright, John Rusconi, Donald VanWagner, Peter Cichetti and Alternate Phyllis Heiko. Luke Kumburis was absent. Others present were William Cole, Ron Cagliostro, Thomas Jantzen, Jesse Cutaia of Hudson Solar, Chris Gilbert, Louise Kalin and Robert Desmond.
MINUTES: A motion was made by John Rusconi, seconded by Don VanWagner to accept the March minutes as presented. All in favor. So carried.
OLD BUSINESS:
CHRISTOPHER GILBERT: AREA VARIANCE - 1401 Route 9 – Tax Map ID#191.04-01-35 and 191.04- 01-36.
Mr.Gilbert submitted an amended application and maps for an area variance requesting a seven foot variance between two accessory structures, the barn and silo, appearing on Parcel A-1. He is seeking to annex the barn to the property, with residence, shown as Parcel A-2. The board reviewed the application for completeness and reviewed SEQRA.
MOTION: A motion was made by Peter Cichetti, seconded by Don VanWagner to accept the application as amended. A roll call vote was held, all in favor. So carried.
A public hearing was scheduled for Wednesday, May 25th at 7:30 P.M. The applicant will send out certified letters return receipt requested and Ag Data Statement to any farming operations within 500 feet of this property. The application and map will be sent to the Town Planning Board for a recommendation and Columbia County Planning for a review. Mr. Gilbert paid the required fee for an area variance.
THOMAS JANTZEN: SPECIAL PERMIT -
Jesse of Hudson Solar is representing Thomas Jantzen for ground mounted solar for his house and barns on 14 acres. There are 56 panels in this array and the panels encompass 3000 square feet. The Town Planning Board reviewed the plans under site plan review. They determined that it was not necessary for screening, as there were no neighbors within view of the panels, therefore recommending waiving this requirement.
A motion was made to accept the application by Phyllis Heiko, seconded by Don VanWagner. A roll call vote was held, all in favor. So carried.
A public hearing will be held on Wednesday, May 25th at 7:30 P.M. Mr. Jantzen paid the special permit fee and the escrow fee.
WILLIAM COLE: SPECIAL PERMIT – 3541 Route 9G – Tax Map ID#190-1-4
Mr. Cole is seeking a special permit with site plan review for the dual use of a auto repair /mechanic shop in the existing business, which he now uses as an office for his construction business and for repairs to his own equipment. This property was formerly used as an auto repair shop. This property has been cleared for use by DEC and curbing has been installed. This application will be forwarded to the County Planning Board and to Clermont Planning Board for site plan review.
A motion was made to accept the application by John Rusconi, seconded by Phyllis Heiko. A roll call vote was held, all in favor. So carried.
A public hearing will be held on Wednesday, May 25, 2016 at 7:30 P.M. Mr. Cole paid the required fees for a special permit and the escrow fee.
There is training for Land use on May 25, 2016 in Cairo from 4:00 to 8:30 P.M.
There is also NYS Floodplain Management Training on May 4th in Ghent.
A motion was made to adjourn at 9:00 P.M. by Don VanWagner, seconded by Phyllis Heiko.
