CLERMONT TOWN BOARD
SPECIAL MEETING
DECEMBER 17, 2008
The Clermont Town Board held a special meeting on Monday, December 17, 2008 at 6:30 P.M. Those present were Supervisor Raymond Staats, Councilman Richard Jones, Councilwoman Carol Lent and Councilman Chris Nolan. Councilwoman Dianne O'Neal was absent. Others present were Brian Clarke, Judy Neary and Andrew Howard, Town Attorney.
Andy Howard, Town Attorney updated the board about the Ackerman Subdivision and Sharon Drive. Ray Jurkowski, engineer for the town, James Potts, Highway Superintendent and Mr. Howard met at the site. It was agreed that the road is well constructed and has weathered well. One area that Jim Potts wanted to address is the storm drain at end of road, which he wants to extend.. The property owners are eager to extend the drain away from their septic system. Andy drafted an easement and they will sign. At the beginning of the road, there is a slight depression and it needs a skim coat of asphalt in the spring. The attorney for Mr. Ackerman did meet with Andy Howard and Ray Jurkowski. A judgement in the amount of $10,000.00 will be filed, to cover payment for work that the engineer will complete, escrow account and work that the highway crew will be doing. There are two parcels remaining to be sold in the subdivision, one fifteen-acre parcel and a one-acre parcel. There are no other judgements filed against the property. This judgement can be filed in other jurisdictions, as well. In connection with the stipulation of settlement, he has agreed that snow can be removed.
The Ackermans have formally asked for a dedication of the road, Sharon Drive, to the Town of Clermont.
MOTION: A motion was made by Councilman Nolan, seconded by Councilman Jones to accept the Consent of Town Board to proposed road accepting Sharon Drive as a Town Highway. All in favor. So carried.
SURVEY: Councilman Jones spoke to Robert Zimmerman about doing the ALTA survey on the entire twenty-acre site. The total cost including auto cad drawing is $2900. DEC does not require a cad drawing, however, C. T. Male would use it. The drawing should be on a CD as well as paper. Councilman Nolan asked if the ALTA survey can be filed with deed, and it can be. This would be paid by Brownfields money that is in budget, and it may be eligible for 90% reimbursement.
Councilman Jones made a motion to have Mr. Zimmerman survey the property for $2700 and Richard Rock to produce the auto cad drawing for $200.00. Councilman Nolan seconded the motion. All in favor. So carried.
A motion was made to adjourn by Councilman Jones, seconded by Councilwoman Lent at 7:25 P.M.
