Hank opens the meeting at 7:30 pm. The meeting starts with a salute to the flag.

Members attending: Hank, Pete, John, Luke, John and Phyllis

Hank asks if anyone has any additions, corrections or omissions to the minutes of the last meeting. The minutes are accepted with an insert from Phyliss that a second use for the propane tanks would create an industrial park. Motion to close the regular meeting and open the public hearing was made by John and second by Luke. All in favor. So moved.

Public hearing for Todd Delgadio for Four Paws Farm, LLC. Located at 1791 County Route 19. Todd explained his need for approval of his special permit to use a mobile home as a residence during construction period. There was no public comment. Motion to close the public hearing was made by Phyliss and second by Hank.

Discussion from the board included that everything was in order.

Roll call vote was called. Hank -yes, John -yes, Phyliss-yes, Luke-yes, and Pete- yes. All in favor and the motion was moved to approve the special permit.

Luke read the short form SEQRA for Four Paws Farm LLC. The board motioned to declare a negative impact as follows. Hank -yes, John-yes, Luke- yes, Phyliss-yes and Pete- yes. So moved.

Pete Cichetti reported the board of health responded directly to the Town Engineer regarding a letter sent by the board. The board of health has not responded to the ZBA.

The ZBA provided a letter as requested, to Ray Statts regarding code violations in town.

There is no old business.

New Business: Kimlin Energy came before the board asking why the special permit was denied for the propane tanks. Hank explained it was not allowed by code. Hank advised their option is to have their attorney request an interpretation of the code. The proposed site is zoned for a retail store. In addition, there are two historical districts in close proximity of the proposed site. Kimlin questioned if they should restructure their application to include a retail store. One option would be to request the area to be zoned to include light industrial park, which would require nine acres for the site. Hank explained Kimlin’s attorney could contact the town attorney for an interpretation. Kimlin inquired if burying the tanks would benefit the issue of the view shed for the Historical Districts.

Motion was made by Phyliss and second by Hank to close the meeting. All in favor. So carried. The meeting closed at 8:20 pm.
