CLERMONT PLANNING BOARD

MAY 13, 2009

The Clermont Planning Board held its regular meeting on Wednesday, May 13, 2009 at 7:00 P.M. at the Town Hall. Those present were Chairman Laurence Saulpaugh, Nancy Sperry, Aldo Dusman, Garret O'Connor, Tom Jantzen and Clayton Andrus. Robert Queirolo was absent.

Others present were Mary and Jack Lester, Robert Desmond, Charles Larsen, Andy Howard, Town Attorney, Ross FennĀ and William and Edward Kahle.

Chairman Saulpaugh opened the meeting. The minutes were reviewed and accepted on a motion made by Garret O'Connor, seconded by Nancy Sperry. All in favor. So carried.

JACK AND MARY LESTER: Submitted an application for a boundary Line change between two parcels that they own on Cemetery Road. The survey map shows removing .528 acres from Parcel B, leaving 3.536 acres and adding the .528 acres to a parcel of 4.617 acres. Parcel B is vacant, but has an approved septic area and is capable of having electric. The proposed area of the septic has the proper distance from boundary lines. There was discussion as to whether a public hearing could be waived as the Lester's own both parcels and this is a simple boundary line change.

MOTION: A motion was made by Nancy Sperry to waive the public hearing, seconded by Clayton Andrus. There was a roll call vote as follows:

Tom Jantzen, aye; Garret O'Connor, nay; Aldo Dusman, aye; Clayton Andrus, aye; Nancy Sperry, aye; Larry Saulpaugh, aye. Motion carried.

MOTION: A motion was made by Nancy Sperry, seconded by Tom Jantzen to accept the survey maps as presented. Roll call vote: Tom Jantzen, aye; Garret O'Connor, abstention; Aldo Dusman, aye; Clayton Andrus, aye; Nancy Sperry, aye; Larry Saulpaugh, aye. Motion carried.

WILLIAM AND EDWARD KAHLE: The Kahles have applied for a special permit from the Zoning Board of Appeals and Site Plan Review from the Planning Board for a second multi-family residence on 3.7 acres on U. S. Route 9. They are not seeking to subdivide the property.

The Kahle's are seeking a multi family building on 4.7 acres where there is currently a multifamily dwelling. There was discussion regarding other multi-family dwellings. The question is whether or not our zoning allows for more than one multi-family unit on a parcel without subdivision. Our Town Attorney will need to research our zoning ordinance. If the parcel was over 25 acres, it could be considered a planned unit development. There is a public hearing scheduled on the May 27th with the ZBA and if the ZBA agrees to the special permit, then they can approve pending subdivision.

The application has been sent to Columbia County Planning for review.

FAMILY SWEETS: An application was submitted by Ross Fenn for Joyce and Jim Shaw for site plan approval for a retail store (Family Sweets) on Route 9 and County Route 6. Since that time, the Shaw's have moved from the building to Red Hook. Mr. Fenn has paid the escrow up to date and has complied with what the Planning Board asked. The light has been installed and a tree stump still has to be removed. There was no one present for or against this project. A motion was made to close the public hearing by Garret O'Connor, seconded by Tom Jantzen. All in favor. So carried.

There is a workshop at the Columbia Green Community College on June 2nd and June 16th on Conservation and Local Planning and the SEQRA Process. All members present will attend at a cost of $120.00 for both sessions.

Discussed Multi-family dwellings and changes to the zoning ordinance to allow them on one parcel.

Motion to adjourn by Nancy Sperry, seconded by Garret O'Connor at 8:20 P.M.
