CLERMONT PLANNING BOARD

JUNE 10, 2009

 

The Clermont Planning Board held its regular meeting on Wednesday, June 10, 2009 at 7:30 P.M. at the Town Hall. In attendance were Chairman Laurence Saulpaugh,

Clayton Andrus, Nancy Sperry, Garret O'Connor, Tom Jantzen and Aldo Dusman.

Others present were George Schmitt, Town engineer, Anna Marie Pintavalle, Charlotte Norman, Jay Trapp, Engineer from Crawford Associates, William Kahle, Scott Kahle, Bob Desmond and Claudia and William Teubl.

Chairman Saulpaugh opened the meeting.

MINUTES: Garret O'Connor noted that the acreage for the Kahle property should be corrected from 4.7 from 3.7 on page 1. A motion was made by Nancy Sperry, seconded by Clayton Andrus to approve the minutes with correction. All in favor. So carried.

CARMELITES HOME FOR THE AGED AND INFIRMED: The Carmelites on Woods Road, represented by Jay Trapp of Crawford & Associates, are seeking approval for a special permit for an office building on the property on Woods Road. The application has been submitted to the ZBA and declared complete and a negative declaration was made on the SEQRA. A public hearing has been scheduled for June 24th.

The present office is in the Mother House, which was built in 1953 and is not suitable for the present day.

They are proposing a 6210 square foot building on the eighty-one acres. The single story building will include a basement for storage and mechanical room, offices, conference room, kitchen, attic for air handlers and additional mechanical equipment.

  1. There will be twenty-one parking spaces around the building but there will be no additional hiring.
  2. This building will be an accessory use to the Mother House in support of existing functions on site.
  3. Deliveries are not significant for the office.
  4. Water for site will be supplied by existing water system.
  5. There is a on-site septic system, approved by the Columbia County Health Dept.
  6. A storm water plan has been submitted to our engineers.
  7. Landscaping will be minimal, trees and shrubs.
  8. Lighting is minimal, using five pole mount lights, two recessed lights, 3 wall lights at entrances of building.
  9. The proposed building will be one thousand feet from Woods Road, 1700 - 1800 feet from river.

Our engineer has raised some questions in a letter of June 10th, which Jay Trapp responded to.

  1. A complete set of plans has been given to George; some schedules were included on that sheet.
  2. A short EAF is included with package submitted tonight.
  3. Coordinating a Phase III archeological study on the property.
  4. Semi impervious area about 8500 square feet but it seems to be less than 10% impervious coverage. Sheet flow to the lowest spot, swale around the back of the building and sheet flow off.

The remaining comments will be addressed.

Chairman Saulpaugh asked if the Planning Board should have a site visit before or after George reviews the plans. When a date is set for a site visit, George will let Jay know.

WILLIAM AND EDWARD KAHLE: The Kahles have applied for a special use permit for construction of a multi-family residential unit on the same parcel with an existing multi-family residential unit on Route 9. Our attorney, Andy Howard, sent a copy of proposed local law #6 for Planned Residential Development. It was reviewed and a recommendation will be given to the Town Board in hopes that the local law will be approved so that this kind of development can be done without having to subdivide a property. The Kahle’s will be awaiting a change to the zoning ordinance, rather than subdividing the property.

WILLIAM AND CLAUDIA TEUBL: The Teubl’s have applied to the ZBA for a special use permit to convert an existing garage to a medical office on 4.4 acres on Nevis Road. The Teubl’s provided a new map, which shows how the garage is located, septic, water and parking are shown. (Add: ‘Dr. Teubl stated that the’) piping and drainage are up against the building ( ‘and’ ) the usage of water in the office should not be significant and lighting is adequate. Dr. Teuble will be doing this part time, because he still has a full time practice. If he did use this office for full time, he would see sixteen to twenty patients per day. The board suggested adding a handicap parking space in the front of the office. The parking should be marked. There is also space available to add more spaces. The road frontage is approximately 300 feet.

A site visit will be held on a date to be decided.

A public hearing with ZBA is going to be scheduled in July.

A discussion with our engineer concluded that the Kahle’s should go through the water testing process for public water supply if they intend to come off the same well for the second building. A letter will be written to the ZBA with a recommendation on the Kahle special permit application.

The Clermont Planning Board recommends approval of the special permit application pending the adoption of Local Law #6 relative to Planned Residential Development, as long as it remains substantially the same as presented to the Planning Board on 6/10/09. The Planning Board would suggest changing Section 3.21 Schedule of Uses for RLB (1 acre) to be a special permitted use. The board also recommends that landscaping be completed in the front yard of both dwellings. The ZBA should also be aware that the applicant might come under public water supply if there are more than five connections per well and it was suggested to the applicant that they go through the water testing process for a public water supply. A motion was made by Nancy Sperry to accept the recommendation to the ZBA, seconded by Clayton Andrus. All in favor. So carried.

A site visit for the Teubl’s and the Carmelite Sisters will be held on Thursday, June 18th at 6:00 P.M. Members (Change: will assemble) (Delete: are to meet) at the Town Hall where they will divide and attend the sites separately.

Robert Queirolo submitted a letter of resignation from the Planning Board effective May 13, 2009. A motion was made to accept the resignation of Robert Queirolo by Nancy Sperry, seconded by Clayton Andrus. All in favor. So carried.

Anna Marie Pintavalle and Charlotte Norman are neighbors of the proposed subdivision by Paul Doherty on Turkey Hill Road. They were present to ask about the proposed hiking trail around the property. The Chairman suggested that they call Mr. Doherty and talk to him about his plans.

A motion was made to adjourn by Nancy Sperry, seconded by Clayton Andrus at 8:50 P.M.
