CLERMONT TOWN BOARD

PUBLIC HEARING

OCTOBER 5, 2009

The Clermont Town Board held a public hearing on Local Law No. 6 of 2009 on Planned Residential Development on Monday, October 5, 2009 at 7:00 P.M. Those present were Supervisor Staats, Councilman Jones, Councilwoman O’Neal, Councilwoman Lent and Councilman Nolan.

Others present were Mary Howell, County Historian, Louise Kalin, Town Historian, Andy Howard, Town Attorney, Ray Jurkowski, Town Engineer, Roy Brown, Supervisor, Town of Germantown and nineteen town residents.

Supervisor Staats opened the public hearing and the Clerk read the public notice.

Attorney Andy Howard noted that the Columbia County Planning Board has reviewed the Local Law and found that the proposal does not have a significant county wide or inter-community impact. Their suggestions do not significantly impact the law.

Comments:

  1. Article VI – Section 6.2 D3- page 5 - Suggested to consider visiting section in density regulation and apply to all dwelling units.
  2. Article VI – Section 6.2 D4 – page 5 – add pursuant to the density control schedule set forth in section 3.22 of the Clermont Zoning Code.
  3. Article VI – Section 6.2 D5 iv– page 5 - Reference parking design standards set forth in section 4.9 of the zoning regulations.
  4. Article VI – Section 6.2 D9 – page 6 - Open space requirement for manufactured home park minimum open space is 10%; in planned development it is 50%. Asked by County Planning to consider whether to require a specific minimum requirement of the total area. Mr. Howard and Mr. Jurkowski do not think a minimum space requirement is necessary.
  5. Suggested that the permits fees be incorporated into a local law. A fee analysis should be considered by board on a comprehensive basis. After discussion it was decided that E – Fees 1a will read an application fee will be charged pursuant to the fee schedule and 3 will be read the same as 1a.
  6. Definition of apartment – added definition on page 2.

PUBLIC COMMENT:

Bob Desmond: When an applicant comes into the zoning board what should they charge the applicant. Bob asked that now that it is taken out how will the board collect the fees. Councilman Nolan suggested a motion to add to the fee schedule. Councilman Jones asked if we could do this at next month’s meeting. Councilman Nolan suggested a separate motion this evening because the ZBA is dealing with an applications for a planned residential unit.

Councilwoman Lent asked if the ZBA is not set up to collect application and escrow fees, would the Town Clerk still have to collect these fees. It can be set up in the fee schedule for the ZBA to require the application fees and escrows. Bob also pointed out that there is an inconsistency for application fees for this type of apartment and other apartments.

Councilman Nolan said of review of the entire fee schedule is necessary.

With no other comments, Supervisor Staats closed the public hearing.
