SPECIAL MEETING

OCTOBER 15, 2009

 

The Clermont Town Board held a special meeting on Thursday, October 15, 2009 at 6:00 P.M. Those in attendance were Supervisor Raymond Staats, Councilwoman Dianne O’Neal, Councilman Richard Jones, Councilwoman Carol Lent and Councilman Chris Nolan.

Others present were Ray Jurkowski, Town Engineer, William Cole of B&T General Contracting, Dagmar Payne, Nancy Moore, Judy Neary, Alberta Staats and Robert Desmond. Supervisor Staats opened the meeting with the salute to the flag.

A motion was made by Councilman Jones, seconded by Councilman Nolan to enter into executive session to discuss personnel matters relating to contracts at 6:00 P.M.

A motion was made by Councilman Nolan, seconded by Councilman Jones to come out of executive session at 6:20 P.M.

Supervisor Staats announced that the bid for the Highway Garage renovation would be awarded to the low bidder, B & T General Contracting. The base bid was $106,000.00 and the bid for the lst alternate for insulation was $14,995.00. The next lowest bid was $112,838.00 for the base and $13,000 for the lst alternate.

A motion was made by Councilman Nolan, seconded by Councilwoman O’Neal to accept the bid from B & T General Contracting. Councilwoman Lent abstained, not because of the project, but because there was no referendum held. Motion passed 4 ayes, 1 abstention.

The start date of the project will be October 16th and it is expected to be completed in four weeks. Ray Jurkowski will write a letter of award to Mr. Cole. An insurance certificate with the Town as additional insured will be supplied. Councilman Nolan asked about other documentation that is required. Ray Jurkowski discussed some of the documents such as prevailing wage documents; signed voucher with certified payrolls must be submitted when payment is requested. Payment will be paid in two installments.

Alternate #2 for the teardown of the office space will be done by the Highway Superintendent and highway crew. Materials will be purchased by him for the job and billed out of the Capital Projects account.

Some questions which arose:

  • Reinforcement of concrete wall was not mentioned in contract. There is bonding along top and ledger board to reinforce.
  • Which type of insulation? Spray foam insulation, closed cell. This will be done as soon as possible
  • Is there mold in the building? There is some on wallboard but this will be pulled down.
  • Color selection for the roof: There are a variety of colors and galvanized to choose from. Most preferred galvanized because of reflective qualities.

Bids for Salt Storage Facility

Two proposals were requested - 42’ x 48’ and 42’ x 60’ (holds additional 75 cubic yards) budgeted for $20,500.00. The highway department has completed the asphalt pad.

Bonded Concrete has the low bid of $5,075.00 and $6,100.00.

Delivery is included but not installation.

Cover-All is the low bid of $14,053.00 and $15,690.00 and based on the number of facilities they have done, they are tried and true.

The Highway Superintendent and highway crew will erect the structure and the concrete blocks. The total of concrete blocks and fabric structure is $21,790.00, which is over allotted budget but under overall budget. Councilman Nolan would like to see the highway salaries paid as force account work. The budget did allot for $15,000.00 for town employees in budget. Can be cost coded for time of employers working on project.

A motion was made by Councilman Nolan, seconded by Councilman Jones to approve the larger salt shed and accept the bid for concrete blocks supplied by Bonded Concrete at $6,100.00 including delivery. Councilwoman Lent abstained, not because of the project but because there was no referendum held. Motion passed 4 ayes, l abstention.

A motion was made by Councilman Nolan, seconded by Councilman Jones to accept the bid from Cover-All Inc. for fabric structure at $15,690.00 including delivery. Councilwoman Lent abstained for reasons noted above. Motion passed 4 ayes, l abstention.

Review of Part II of the Environmental Assessment Form for the 20-acre parcel:

  • There was discussion on #6 regarding drainage flow or water runoff, which was answered no. The flow of the water from stream to pond is not being changed, but Councilman Nolan argued that it could be altered and that we should answer yes. No change.
  • There was discussion on #10 impact on agricultural land resources which was answered yes. No change.
  • A change was suggested on #16 Impact on Energy. The board would like Solar panels to be added for other impacts.
  • There was discussion on #19 Impact on Growth and Character of Community or Neighborhood. Change to yes and note small impact to municipal budget.

A motion was made by Councilman Jones, seconded by Councilwoman O’Neal to declare a negative declaration. All in favor. So carried.

Supervisor Staats advised the board that Marina Schmid would be resigning as secretary of the Zoning Board of Appeals on December 31, 2009 for personal reasons.

The Clerk was advised by the Real Property Tax Service that the term of John Halterman expired on September 30, 2009 from the Board of Assessment Review.

Supervisor Staats asked Councilwoman Lent if she had brought in the records from the Easter Egg Hunt that have been requested in a FOIL request. She replied that there is a donor list upstairs in the Town Hall and the bank statements went to then Supervisor William Banks and then Accountant Mark Fitzgerald. Copies have since been provided to the State auditor. (Add: Supervisor Staats asked what auditor Ms. Lent provided these documents too, as the auditor working in our town has not received any of these records.) She will supply the statements to Supervisor Staats. Councilwoman Lent has questions about the Village Green committee using town letterhead to send out donation requests for the barbecue. It makes it look like it is the town that is making the request when the town budgeted a donation for the event. Dagmar Payne said it was advertised as a Village Green Committee Barbecue.

Councilman Nolan would like an announcement posted on the website about a fund raising benefit for handicapped, which will be held Rhinebeck by the National Rifle Association on October 24.

A motion was made to adjourn by Councilman Jones, seconded by Councilman Nolan at 7:50 P.M.
