CLERMONT PLANNING BOARD
OCTOBER 14, 2009
The Clermont Planning Board held their regular meeting on Wednesday, October 14, 2009 at 7:30 P.M. at the Town Hall. Those present were Laurence Saulpaugh, Nancy Sperry, Clayton Andrus, Tom Jantzen, Garret O'Connor and Jennifer Phillips. Aldo Dusman and Brenda Case were absent. Brenda Case was appointed on October 5, 2009 by the Town Board to replace Robert Queirolo who resigned. Jennifer Phillips was also appointed on October 5, 2009 by the Town Board as an alternate member of the board.
Others present were Andy Howard, Town Attorney, George Schmitt of Morris Associates, Robert Zimmerman, Jay Trapp, Scott and William Kahle, Linda and Gary Delaurentis, Charlie Lent, Arthur Schade and Bob Desmond.
Garret O'Connor made a motion to approve the minutes of the September meeting. Clayton Andrus seconded the motion. All in favor. So carried.
A motion was made by Garret O'Connor, seconded by Clayton Andrus to close the regular meeting and open the public hearing for Lothar and Marianne Gruber’s application to subdivide on Cedar Hill Road.
GRUBER: The Gruber's were represented by Robert Zimmerman, surveyor, for a subdivision of 9.95 acres on Cedar Hill Road into two parcels, Lot 1 – 5.738 and Lot 2 – 4.216 acres. The monumentation is shown on the map and the notation regarding zoning was changed to 2 acres. The approval for the septic system on Lot #2 is stamped on one map, but he will bring in additional stamped maps. Receipts were submitted for the certified mailings, deed descriptions and electric will be installed underground. Mr. Schade, an adjoining landowner, asked if the lots can be further subdivided. The way the lots are laid out with the residence in the center and the location of the well and septic, it is unlikely that the setbacks could be met for further subdivision. He also asked about another neighbor who has put in a second driveway when they subdivided but never uses it. It was explained that this is allowed, as long as they have the driveway, which could be used if necessary. Mr. Zimmerman pointed out that there has to be two acres which are developable land and a road would take up quite a bit of the acreage on either lot so subdivision is not likely.
A motion was made by Garret O'Connor, seconded by Nancy Sperry to close the public hearing. All in favor. So carried.
Chairman Saulpaugh reviewed the EAF short form and a motion was made by Nancy Sperry, seconded by Clayton Andrus to declare a negative declaration. All in favor. So carried.
A motion was made by Nancy Sperry, seconded by Garret O'Connor to approve the subdivision as presented. All in favor. So carried.
KAHLE – U.S. ROUTE 9: The Kahle's applied for a special use permit to the ZBA to build a second four family apartment on U.S. Route 9 on 3.7 acres. The Planning Board recommended approval pending the adoption of Local Law #6 of 2009 relative to Planned Residential Development so that they would not have to subdivide the parcel. The Chairman read the letter of June 15, 2009 to the ZBA. The ZBA has held the public hearing and approved with conditions.
GARY DELAURENTIS- Commons Road: Mr. Delaurentis has applied to the ZBA for a special use permit and rear setback variance to convert a barn to a two family residence. There is currently one apartment on the top floor. Chairman Saulpaugh and Ray Jurkowski, Town engineer, visited the site on October 10th to check the septic system, which was installed in 2003. A letter from the ZBA to the applicant was read which approved the request with conditions. A letter will be written to John Fieser that the site visit was made on October 10th by the Chairman and Ray Jurkowski that it was agreed the septic system in place is adequate for three-bedroom facility.
TEUBLS – Nevis Road: The Teubl’s are withdrawing their application to convert an existing garage into a medical office.
CHARLES LENT – Cemetery Road: Mr. Lent has a ten acre parcel on Cemetery Road which he would like to subdivide three acres with a 50 foot easement to go to his son. The parcel has 200 feet of road frontage on Cemetery Road. He has also been asked by the Viewmont Cemetery, which adjoins this parcel, for a strip of land, which he will be giving to them. The board advised him to do the subdivision and the lot line adjustment at the same time. He will come back in to the board.
WILLIAM COLE – U. S. Route 9G: Mr. Cole has asked that maps be restamped for a boundary line change, which was approved in January. The maps were over the time period for filing. Copies were stamped on a motion made by Nancy Sperry, seconded by Clayton Andrus. All in favor. So carried.
CARMELITE SISTERS: Jay Trapp of Crawford & Associates brought in the balance due on the escrow account and additional maps to be stamped for site plan application which was approved last month for the Carmelite Sisters office building.
A motion was made by Garret O'Connor, seconded by Nancy Sperry to adjourn at 8:45 P.M.
