CLERMONT PLANNING BOARD
JANUARY 13, 2010
The Clermont Planning Board held its regular meeting on Wednesday, January 13, 2010 at 7:30 P.M. at the Town Hall. Those present were Chairman Laurence Saulpaugh, Clayton Andrus, Tom Jantzen, Aldo Dusman, Jennifer Phillips and Brenda Case. Nancy Sperry was absent.
Others present were George Fox, George Schmitt of Morris Associates, Robert Desmond,
Norris Lee, Harry Hill, Charles Lent, Andy Howard, Town Attorney and Robert Zimmerman.
Chairman Saulpaugh opened the meeting.
MINUTES: A motion was made by Clayton Andrus, seconded by Aldo Dusman to approve the minutes of the December meeting. All in favor. So carried.
MOTION: A motion was made by Clayton Andrus, seconded by Tom Jantzen to close the meeting and open the public hearing on the Lent subdivision and boundary line change.
CHARLES LENT: Mr. Lent is proposing a subdivision of 4.034 acres from approximately ten acre parcel and a boundary line change merging a twenty five foot wide x five hundred foot section to the Cemetery lands. This public hearing was continued from December. Mr. Lent brought in the certified receipts of the mailings to adjoining landowners. The perc test was done and sent to the Health Department but the deep hole test cannot be done until spring. Aldo Dusman asked if we should wait to stamp the maps until the health department has done the test. Mr. Lent understands that he will have to wait until the test is done. Jennifer Phillips asked about the access to the parcel. There is 100 feet set aside for both parcels for access. The board noted that the correct acreage of the subdivided parcels and access parcels should be noted on the map. It was discussed that the County Clerk’s office may not accept maps with color, as they do not scan into the computer. Mr. Lent will check with his surveyor. George Fox was present from the Cemetery Association in favor of this action. There was no one else present for or against this action.
A motion was made to close the public hearing by Aldo Dusman, seconded by Clayton Andrus. All in favor. So carried.
A motion was made by Clayton Andrus, seconded by Aldo Dusman to accept this proposal conditional on board of health approval, updating the map with acreage and changing the map colors if necessary for filing with the Clerk’s office. All in favor. So carried.
BARBARA LEE SUBDIVISION: The family of Barbara Lee is seeking subdivision of 65.52 acres from a parcel of 159 acres more or less which is separated by Moore Road. Ms. Norris Lee, Harry Hill and surveyor Robert Zimmerman were present. Mr. Zimmerman checked at the County Clerk’s office and the parcel is shown as one. The tax maps shows the parcel as two. There are separate deeds on file at the clerk’s office for three parcels, including the parcel with the residence and 5.52 acres. There have been no subdivisions made to this property. Mr. Zimmerman asked if he should show houses around the entire parcel. The board does not see the necessity of doing that. He will note on the map that this is not an actual field survey. Andy Howard stated that the parcels were described separately by deed but set up as one tax map parcel. In approving this subdivision and creation of a tax map parcel, a notation that Parcel #2 for 65.52 acres requires a survey. The parcel has had a percolation test. A public hearing will be set up for February. Our engineer should see that the notations have been added before the public hearing. Certified letters should be sent out to all adjoining landowners. House, barn, well and septic should be located on Parcel #1 Locate house and barn on parcel #1.
WILLIAM TEUBL: Nevis Road - A letter was written to Mr. Teubl from the ZBA that the project for an accessory use must be started no later than one year from the date of application. Mr. Teubl has stated that he is not going to do this project at this time. The concern the Planning board had was the width of the driveway and site distance on Nevis Road. There were also parking issues and the end of the driveway was very narrow.
MANUAL PINHO: The board received a letter from DEC on notice of complete application by Manuel Pinho who is proposing a three bedroom house on an existing garage foundation, driveway parking area and lawn located within a l00 feet of wetlands. A septic and well are proposed to be located outside the wetland boundary on US. Route 9.
Project is unlisted action, with no significant impact on environment. A negative declaration is filed. This is only a notice, not a permit.
With no other business, a motion was made by Clayton Andrus, seconded by Aldo Dusman to adjourn at 8:35 P.M. All in favor. So carried.
