CLERMONT PLANNING BOARD

The Clermont Planning Board held its regular meeting on Wednesday, February 10, 2010 at 7:30 P.M. at the Town Hall. In the absence of Chairman Saulpaugh, Clayton Andrus, Deputy Chairman opened the meeting. Those present were Clayton Andrus, Jennifer Phillips, Aldo Dusman, Tom Jantzen and Brenda Case. Chairman Saulpaugh and Nancy Sperry were absent.

Others present were Norris Lee, Robert Zimmerman, Surveyor, George Schmitt, Town Engineer, Andy Howard, Town Attorney and Robert Desmond.

MINUTES: A motion was made to accept the minutes of the January meeting by Aldo Dusman, seconded by Tom Jantzen. All in favor. So carried.

A motion was made to close the regular meeting and open the public hearing by Aldo Dusman, seconded by Tom Jantzen. All in favor. So carried.

BARBARA LEE LAND TRUST: The public hearing of the Barbara Lee Land Trust was opened. Norris Lee, applicant and Robert Zimmerman, surveyor for the applicant was present. The applicant is seeking to subdivide 65.52 acres more or less on the west side of Moore Road. The applicant mailed the certified letters to adjoining landowners and agricultural data statement was sent to the Moore Farm on Nevis Road. Approval for placement of driveway was received from Highway Superintendent Jim Potts. Deeds were submitted for Parcel l, 2 and 3 by Mr. Zimmerman. Mr. Zimmerman added notes on the map not certifying to location, flow or potability of water supply, location or existence of restrictions, covenants, easements or any other regulations which may affect the development of and/or construction on this parcel, and certifying that a septic system can be placed on the 65.52 acre parcel, subject to engineer’s design and approval by Columbia County Board of Health. He also ran the metes and bounds description from the deed through the computer and it is very accurate. He feels very comfortable with certifying this parcel. There was no specific spot picked for a septic system and a letter was received from the department of health requiring that a certified NYS professional engineer be employed to develop a suitable septic system on the property. This was based on Richard Jones soil evaluations of the property. Mr. Howard checked and this subdivision did not have to be referred to the Columbia County Planning Department.

A motion was made by Aldo Dusman to close the public hearing, seconded by Brenda Case. All in favor. So carried.

The SEQRA form was reviewed by the board. A motion was made by Aldo Dusman to declare a negative declaration, seconded by Tom Jantzen. All in favor. So carried.

A motion was made by Aldo Dusman to accept the maps as presented, seconded by Tom Jantzen. All in favor. So carried.

A letter was read from the Hudson River Heritage which asked the board to consider the impact of subdivisions or developments will have on the Historic Hudson River National Historic Landmark District which along the Hudson River and Route 9G from south of Germantown down beyond Poughkeepsie. They would like to be advised of any applications which might have an affect any property in the District.

PINHO: Received notification from DEC allowing Manual Pinho to construct a three bedroom house within the 100 foot fresh water zone on his property on Route 9, approximately ½ mile south of Cedar Hill Road. The septic system and water well are proposed to be located outside the wetland adjacent area.

SCHEDULE OF FEES: The Town Board is considering revising the schedule of fees for the Building Inspector and other Zoning related fees. Town Board member Bob Desmond is getting input from the building inspector, Planning Board and Zoning Board of Appeals. Councilman Desmond is asking for any suggestions from the boards for any fees that they would like to see increased or decreased so that the Town Board can change them and adopt them at a public hearing. In particular, they are looking at recreation fees between minor and major subdivisions at being the same. The use of a lot between a minor and major is used for the same purpose. Andy Howard stated that it would be a complete reversal to say smaller minor subdivisions are exempt. There should be an in depth analysis of the use of the land and whether or not the subdivision is located near an already existing park in determining recreations fees. The recreation fees collected in the past years were not separated from the general fund, but now they will be going forward. Suggested adding a recreational fee for multi family units. There was discussion of having a fee for interpretations made by the ZBA and higher fees for variances and special permits.

Site Plan review: charging $50.00 for residential and $150.00 for commercial currently, this could be increased. Consider increasing escrow amounts for major subdivision and adding that the ZBA can collect escrows. Jennifer Phillips asked it was standard to have a fee for solar and wind. Andy Howard replied that this is the Planning, Zoning Boards and building inspectors way to know that standards are being followed as far as load on the roof, etc. Tom Jantzen suggested a 25% increase across the board to the fees.

Andy suggested setting a base for escrow at $500.00 or have applicant of large subdivisions sign an escrow agreement. Aldo Dusman suggested increasing application fees for major subdivision and recreational fee for major subdivision.

Andy Howard will look at recreational fees and applications fees for other towns in Columbia County. Clayton Andrus suggested considering towns in Dutchess and Columbia for an average. Bob Desmond asked Andy Howard to give us wording for escrow.

A motion was made by Aldo Dusman, seconded by Tom Jantzen to adjourn at 8:45 P.M.
