CLERMONT PLANNING BOARD
APRIL 14, 2010
The Clermont Planning Board held its regular meeting on Wednesday, April 14, 2010 at 7:30 P.M. at the Town Hall. In attendance were Chairman Larry Saulpaugh, Nancy Sperry, Tom Jantzen, Aldo Dusman, Brenda Case, Jennifer Phillips and Clayton Andrus.
Others present were George Schmidt, Matthew Griesemer of Freeman Howard, Marie Welch, Nora Moran, Bob Desmond and Michael Camann.
A motion was made by Nancy Sperry, seconded by Clayton Andrus to accept the minutes of the March meeting. All in favor. So carried.
A motion was made by Nancy Sperry, seconded by Clayton Andrus to close the regular meeting and open the public hearing of the Jantzen Estate for a boundary line change on Commons Road. Tom Jantzen recused himself from the public hearing and the discussion.
PUBLIC HEARING:
The Estate of Alfred Jantzen, represented by Marie Welch, surveyor, are seeking a boundary line change on Commons Road of what was originally the road. If approved this portion of the old road will be adjoined with eight properties to the east. No one was present to speak for or against this boundary line change. All of the adjoining property owners were noticed and the attorney does not think we need a letter from any of the parties, with the exception of Mrs. Arsenault, who did not receive the certified letter. The town should give a quit claim deed to the parties to give up any ownership to the land. Marie Welch will do a metes and bounds description, the Moran’s attorney will draw up the deeds. Presently, the property owners are using this as a town road, but Highway law allows them to continue to use this as a town user road, even if John and Nora Moran take ownership. Wherever it is possible, property markers will be set.
The Board would like a letter from each of the property owners. Ms. Welch should send copies of the map to our engineer and town attorney.
The public hearing will be continued next month on a motion made by Clayton Andrus and seconded by Nancy Sperry. All in favor. So carried.
A motion was made by Nancy Sperry, seconded by Clayton to enter into the regular meeting. All in favor. So carried.
Michael Canann is seeking a special permit at County Route 6 and Route 9G for a vehicle display lot. He would have no more than four cars displayed at one time on the south section of the parcel. There will be no additional ingress and egress needed, the pricing and description of the vehicles will be on the cars themselves, so no signage. It is necessary to have special permit approval in this zone. If the property is sold and the new owner does not want this, then he is out. Brenda Case asked about vehicles entering and leaving the property, but there are two curbs cuts off Route 9G and one off Route 6.
After further discussion, the Planning Board being familiar with the property, motioned that a letter be written to the Zoning Board recommending approval for the special permit by Nancy Sperry, seconded by Clayton Andrus. All in favor. So carried.
Red Wing Properties is seeking a permit from DEC to mine 49 feet below the water table and use the gravel taken at the Roe Jan Mine. The Planning board forwarded the information to Morris Associates for review. George Schmitt, in a letter to the board, recommends review of the application and a public hearing, as a special permit is necessary in the RA zone and Roe Jan zone. State law limits the review by towns, but there are issues, which the town can speak to. Although DEC has tentatively approved the permit, there is a public hearing process, and the town can ask for an extension and DEC must grant it. This will give the town time to look into this.
An email was received from Donna Marquardt against the modification of the gravel mine.
A motion was made by Nancy Sperry, seconded by Jennifer Phillips for Morris Associates to contact DEC regarding the Red Wing Properties application and request an extension of the public comment period. There was further discussion about the mining operations and possible ways to control aspects of it.
A motion was made to adjourn by Nancy Sperry, seconded by Brenda Case. All in favor. So carried.
