CLERMONT PLANNING BOARD
MAY 12, 2010
The Clermont Planning Board held their regular meeting on Wednesday, May 12, 2010 at 7:30 P.M. at the Clermont Town Hall. Those present were Chairman Laurence Saulpaugh, Nancy Sperry, Clayton Andrus, Thomas Jantzen and Brenda Case. Aldo Dusman and Jennifer Phillips were absent.
Others present were Town Attorney Andy Howard, Town Engineer George Schmitt, Robert Desmond, John and Nora Moran.
Chairman Saulpaugh opened the meeting at 7:30 P. M. A roll call vote was held. A motion was made by Nancy Sperry, seconded by Clayton Andrus to accept the minutes of the April meeting.
Clayton Andrus made a motion to close the regular meeting and to open the public hearing, Nancy Sperry seconded. All in favor. So carried.
JANTZEN ESTATE: This hearing was continued from last month. Thomas Jantzen recused himself from the discussions. John Moran submitted letters from all the property owners acquiring a portion of lands of the Estate of Alfred Jantzen on Commons Road.
Andy Howard, Town Attorney asked Highway Superintendent Potts to check for an abandonment of the portion of the road, but he did not locate anything. There is supposed to be an Abandonment of a Road Certificate on file. Andy explained that a quit claim deed would involve payment by the neighbors. He may get Jim to file an abandonment of the road with the Town Clerk and it can be filed on the map, which gets filed at the County Clerk.
A motion was made to close the public hearing by Clayton Andrus, seconded by Nancy Sperry. All in favor. So carried.
Bob Desmond asked if the Town Board had to approve abandonment, or is this the Highway Superintendents decision. Andy and George Schmitt do not think so, but will check on it. Andy will prepare it and file it with the County.
Brenda Case asked about use of an abandoned road. If it was a user road that town maintained then property owners would own to the middle of the road. Marie Welch, surveyor for the Jantzens will be doing a metes and bounds measurement for the deeds for each property owner.
RED WING PROPERTIES: Bob Desmond said the zoning law requires a special permit for a gravel mine. Andy said if they are altering the mine, we can control ingress and egress, however, Chairman Saulpaugh said that he entrance to the gravel bank is in Milan. Andy thinks that it would be in their interest to have them come in and apply for a special use permit. They are better off getting a use permit. Chairman Saulpaugh suggested that George get in touch with Paul Doherty and tell them that they should apply for a special use permit because they are changing the use. Andy will write a letter to Paul Doherty to have him come into the ZBA and file an application for a special use permit. They do not see the need for a site plan review by the Planning Board because DEC has the authority on the plan.
Bob Desmond – A zoning review will be starting by the town board and he would like a list of those things, which should be looked at or changed in the zoning. The list will be prioritized this year and budgetary planning done for next year. There has been talk about commercial vehicles on private property.
Discussed possible legislation on banning outdoor wood boilers.
A motion was made to adjourn at 8:25 P.M. by Nancy Sperry, Brenda Case seconded. All in favor. So carried.
