CLERMONT PLANNING BOARD
OCTOBER 13, 2010
The Clermont Planning Board held its regular meeting on Wednesday, October 13, 2010 at 7:30 P.M. Those in attendance were Chairman Laurence Saulpaugh, Nancy Sperry, Clayton Andrus, Thomas Jantzen, Aldo Dusman, Jennifer Phillips, Scott Dow, Scott and Theresa Delaurentis, April and Michael Delaurentis, George Schmitt, Town Engineer, Andy Howard, Town Attorney and Robert Desmond.
Aldo Dusman asked to make a correction on page 1, in the third paragraph, after 75 feet, add ‘of road frontage’. The minutes were approved with correction on a motion made by Clayton Andrus, seconded by Nancy Sperry. All in favor. So carried.
DELAURENTIS: Aldo Dusman recused himself from the discussion. Scott and Theresa Delaurentis have proposed a subdivision of twenty nine acres on Trout Creek Road into two parcels – Lot A – 18.713 acres and Lot B – 10.483 acres. Mr. Delaurentis brought in maps showing a 50 foot reserved easement area from Trout Creek Road, which will serve as a common driveway to the residence on Lot A and Lot B and can be used eventually for a town road should there be further subdivision of Lot A or connecting land.
Chairman Saulpaugh asked Andy Howard if a bank would have any problem giving a loan on property with the fifty-foot easement. Andy did not think so if the subdivision and easement are approved.
Chairman Saulpaugh asked if the town would be compelled to put in a town road if someone bought parcel A. Andy’s response was that the town would not be. He suggested that a common driveway maintenance agreement between Lot A and Lot B be drawn up by their attorney.
There was discussion regarding the angle of the turn on the proposed 50-foot easement. It was suggested that our engineer George Schmitt address the angle of the turn and advise Mr. Delaurentis surveyor prior to the meeting to see if there needs to be a change.
The following are issues, which should be addressed before the next meeting.
- The angle of the turn.
- Common driveway and maintenance agreement for shared driveway.
- Note on map that this minor subdivision supercedes all prior subdivision maps approved by the Clermont Planning Board.
- Deeds descriptions should be drawn up by their attorney
Tom Jantzen asked if any other landowner along this line should have an agreement. Andy said that Mr. Delaurentis is maintaining ownership of the easement.
All maps and paperwork should be submitted at least ten days in advance before the public hearing is set up. The next meeting is November 10th at 7:30 P.M.
There was discussion on the underground electric and whether or not this would be a problem if this should become a town road. George did not think it would be an issue, but it is important to know where it is located. The applicants submitted Board of Health approval for the septic system of the new house and building permits for both residences.
Jennifer Phillips pointed out that Lot B only shows 407 feet of frontage on the stream.
It was noted that the power lines prevent them from having the frontage.
George will speak to Mr. Ihlenburg about this measurement. They may actually have more. Jennifer Philips opened a discussion about the shared driveways and if by defining an easement you could end up with more parcels.
Aldo Dusman is concerned about allowing this easement, as there have been other situations where applicants have been denied with the same situation. Andy Howard pointed out that the board is exercising a design function, and the board can make a condition that there can be no further subdivision, absent a town road. These are existing homes on one parcel, which can now be corrected. If conditioned that there can be no further subdivision, you are dealing with the existing lots and creating a blueprint for the future. George said the boards rationale can be entered into the minutes within the motion after the public hearing.
There was discussion about the location of septic, electric and wells on both lots. Scott Dow, Jennifer Phillips and Tom Jantzen decided to make a site visit on Sunday, October 17th at 4:30 P.M. Mr. Delaurentis will be notified.
A motion was made by Nancy Sperry, seconded by Tom Jantzen to adjourn at 8:40 P.M.
