CLERMONT PLANNING BOARD
NOVEMBER 10, 2010
The Clermont Planning Board held its regular meeting on Wednesday, November 10, 2010 at 7:30 P.M. at the Town Hall. Those in attendance were Chairman Laurence Saulpaugh, Nancy Sperry, Clayton Andrus, Thomas Jantzen, Jennifer Phillips, Aldo Dusman and Brenda Case. Also present were George Schmitt, Town Engineer, Robert Zimmerman, Robert Desmond, Andy Howard, Town Attorney, Scott Delaurentis, Theresa Delaurentis and April and Michael Delaurentis.
Minutes: A motion was made by Nancy Sperry, seconded by Clayton Andrus to accept the minutes of the October meeting. All in favor. So carried.
A motion was made by Nancy Sperry, seconded by Clayton Andrus to open the public hearing of Scott and Theresa Delaurentis.
SCOTT AND THERESA DELAURENTIS: Aldo Dusman recused himself from the discussion. The applicants submitted the deed description for Lot A and Lot B. There should have been an agreement for the shared driveway but it was not received. There was discussion that the board can make the approval conditional, upon receiving the agreement, before maps are stamped. Larry asked if there are any easements for the electric. George Schmitt agrees that the angle of the turn for the driveway will be sufficient and does work.
Andy has concerns about the reserved easement area for parcel B. Measurements included in written easements do not show on the survey map. Parcel B has to be able to go right from Trout Creek Road east all the way through. The applicants will need to submit the following:
- Driveway maintenance agreement.
- Description of Reserved easement, there is no depiction where the easement ends.
- Legal deed description for lots.
- Final Map, no color, Clerk will not accept.
- The well will have to be located 100 feet from the boundary line for Lot B
- There is an easement from National Grid for power, pursuant to a legally filed easement. Should be shown on map.
- Put the numbers of easement right on the map. Note on map subject to utility easement, etc.
A motion was made by Nancy Sperry, seconded by Clayton Andrus to continue public hearing until next month. All in favor. So carried.
Aldo Dusman is back in the meeting.
MARY JANE FUCHS: County Route 6 and Wright Road. Robert Zimmerman, surveyor for Mrs. Fuchs explained to the board that Mrs. Fuchs wants to transfer property to her daughters and make a lot line adjustment of 1.9 acres and 3 acres to add to a parcel of Theresa Fuchs on Wright Road.
There is a question of how many lots can be subdivided from the original parcel before it is considered a major subdivision. Andy Howard will check to see if there is a time limit on subdivision until they become major subdivision. Some provisions of the major subdivision can be waived because there is ample road frontage. There may be issues about the fees but there are provisions, which can be waived.
Andy Howard also explained that there is the issue of segmentation but he would not consider this in this case, because there has been a change, owner has passed away.
Discussed the boundary line change by William Cole, which was brought up at the recent town board meeting. The applicant did send out notices, but may have neglected to send to those across the street.
Aldo Dusman stated that usually we all agree as board members, but lately we have not been agreeing. Talked about the subdivision application packet and what is expected by the applicant to be submitted prior to the meeting.
Brenda Case suggested that having a review night might alleviate this problem. During the public hearing more things might surface.
Andy Howard stated that there is a public service function that the board can serve. When an application is substantially complete a motion can be made for a public hearing. The public hearing can be continued or can be closed, application can be denied so that applicant has to start over again.
A motion was made by Nancy Sperry, seconded by Jennifer Phillips to adjourn at 8:52 P.M.
