CLERMONT PLANNING BOARD
DECEMBER 8, 2010
The Clermont Planning Board held their regular meeting on Wednesday, December 08, 2010 at 7:30 P.M. at the Town Hall. Those members present were Chairman Laurence Saulpaugh, Clayton Andrus, Nancy Sperry, Thomas Jantzen and Brenda Case. Aldo Dusman and Jennifer Phillips were absent
Others present were George Schmitt, Town Engineer, Andy Howard, Town Attorney, Robert Zimmerman, Charles Lent, Chad Lent, Bob Desmond, April and Michael Delaurentis and Scott and Theresa Delaurentis.
Minutes: The minutes of the November meeting were approved on a motion made by Tom Jantzen, seconded by Nancy Sperry.
Motion to close regular meeting and reopen the public hearing was made by Nancy Sperry, seconded by Clayton Andrus.
SCOTT AND THERESA DELAURENTIS: The applicants brought in a maintenance agreement, the map in black and white and the National Grid easement.
Andy Howard and George Schmitt agreed that all looked okay.
They suggested that the board, subject to further planning board review, make it clear that in connection with approving this subdivision, that there are two parcels on the lot with a 50 foot reserved area. The reserved area could be required to be brought up to specifications. The planning board has the ability to require this for the public safety aspect. The reserved easement is beneficial to the board and the applicant for any future development. Parcel A is responsible for the maintenance of the filed easement and this goes with the parcel forever.
A motion was made by Nancy Sperry, seconded by Clayton Andrus to close the public hearing.
Chairman Saulpaugh reviewed the SEQR application. A motion was made by Nancy Sperry, seconded by Clayton Andrus to declare a negative declaration.
A motion was made by Nancy Sperry to accept the minor subdivision as presented by Scott and Theresa Delaurentis with a condition of approvement on the driveway easement, seconded by Tom Jantzen. All in favor. So carried.
Discussion on minor subdivision and major subdivision: After the last meeting, Andy Howard looked into the issue on when a minor subdivision becomes a major subdivision.
There is no limitation in the town ordinance nor is there one provided by the State on looking back on when a minor subdivision becomes a major subdivision. The applicant must take care not to put themselves in a position that they cannot furthersubdivide.
FUCHS: Mr. Zimmerman, representing Mary Jane Fuchs, explained the history of the parcel and what the applicant would like to do. There were two lots subdivided that were in Germantown and only one lot subdivided in 2001 from this parcel. They would be subdividing four lots and making a lot line adjustment to add to one daughters property.
George does not see the difference in this case, because the town road runs through this parcel. The fees for major subdivision is one variable.
With subdividing four lots you almost always have to do a SWEPP because of the limit of disturbance. It was suggested subdividing two lots at this time and leave the eight-acre lot until further down the road. Larry asked if it is necessary to have the septic sited on these parcels. George thinks they should have a perc test on the lots so that the board knows that they are buildable lots.
The question was asked if this could be done by a certified engineer rather than the health department. It can be as long as it is stated that this is not a buildable lot.
CHARLES LENT: A public hearing was held in December 2009 for a subdivision of 4.034 acres from a ten acre lot on Cemetery Road and a boundary line change of approximately 25’ x 500’ to be annexed to the Viewmont Cemetery Association property. Mr. Lent brought in the septic approval; a letter from the Cemetery Association and the lots numbered on the black and white maps.
A motion was made to adjourn by Nancy Sperry, seconded by Brenda Case at 8:40 P.M.
