CLERMONT PLANNING BOARD
OCTOBER 12, 2011
The Clermont Planning Board held its regular meeting on Wednesday, October 12, 2011 at 7:30 P.M. at the Town Hall. In attendance were Chairman Laurence Saulpaugh,
Thomas Jantzen, Clayton Andrus, Aldo Dusman, Jennifer Phillips and Scott Dow, Alternate. Absent was Brenda Case. Also present were George Schmitt, Town Engineer, Andy Howard, Town Attorney, Robert Desmond, Tyson Kreig and Robert Zimmerman.
Chairman Saulpaugh opened the meeting. The Chairman asked that a letter be written to Nancy Sperry thanking her for serving on the board and as secretary.
MINUTES: Clayton Andrus noted a correction to the September meeting minutes, page 1, date of scheduled public hearing should be October 12th. A motion was made to accept the minutes with correction by Jennifer Phillips, seconded by Clayton Andrus. All in favor. So carried.
A motion was made to close the regular meeting by Clayton Andrus, seconded by Jennifer Phillips and open the public hearing. All in favor. So carried.
PUBLIC HEARING:
MARY JANE FUCHS: 351 Cedar Hill Road – Tax Map ID 191-00-01-32.1 - Mrs. Fuchs was represented by Robert Zimmerman, surveyor. An application for a subdivision of 1.58 acres located on the north side of Cedar Hill Road, which is included in the deed of a 92-acre parcel, located on the south side of Cedar Hill Road has been submitted. This parcel is in the RA 2-acre zone. Mrs. Fuchs was granted an area variance by the ZBA. Scott Dow asked if there was 150 feet of road frontage? There is over 200 feet. The map shows one well for the existing house on this parcel and on the next parcel. Aldo Dusman asked if each residence should have a separate well? Andy Howard said that at the very least there should be an easement agreement. George Schmitt agrees that there should be a separate well or an easement. There was further discussion about whether or not there should be an easement and maintenance agreement on the well because there is one well for the two residences, and also how extensive the agreement should be. Mr. Zimmerman will suggest to Mrs. Fuchs that she has an easement/maintenance agreement written up. Tom Jantzen also suggested that Mr. Zimmerman might even suggest drilling a well. This can be approved subject to having an agreement for the well. There was no one present to speak for or against this subdivision. A motion was made to close the public hearing by Aldo Dusman, seconded by Tom Jantzen. All in favor. So carried.
Upon review of the environmental assessment form, a motion was made by Clayton Andrus, seconded by Tom Jantzen to declare a negative declaration, as there is no environmental impact by this action. All in favor. So carried.
A motion was made to approve this subdivision as presented, pending the easement/maintenance agreement for the well or a new well being drilled by Aldo Dusman, seconded by Tom Jantzen. All in favor. So carried.
TYSON KREIG: 1223 County Route 6 – Property of Tammy McCarthy-Garcia - Mr. Kreig is representing Ms. Garcia and submitted a site plan application to convert a one family residence to a two family residence on County Route 6. This property has a horseshoe driveway and his sketch shows a parking area for three vehicles, which Mr.Kreig said, is what the code calls for. (1 ½ per unit) The standard size is 9 x 20 for a vehicle. There is no survey; he is going by the deed description. Mr. Kreig says that there is adequate parking within the area.
Mr. Kreig did call the health department and they said it goes on the bedroom count and it is a pre-existing septic system. He is not increasing the bedrooms; he is reducing it by one. Aldo Dusman would like to see a better sketch because it is such a small lot and he may not meet all the requirements of setbacks. The applicant must be able to show that the vehicles do not have to back out onto County Route 6. There will be a site visit on Thursday by Aldo, Tom and Scott at 9:00 A.M. If the parcel is undersize, they are going to ask for a survey.
Andy Howard said that the conversion to a two or one family requires a special permit from the ZBA. Mr. Kreig has applied to the ZBA for a special permit and the hearing will be held on October 26th at 7:30 P.M.
Robert Desmond showed the board the completed proposed zoning map with the new Nevis Hamlet boundaries. He asked for a short letter to the Town Board that the Planning board approves of the changes. A letter will be written.
WALTER HUNT: 350 East Camp Road – Tax Map ID 168-1-4- A motion was made by Clayton Andrus, seconded by Tom Jantzen to recommend for approval the Walter Hunt application to the ZBA for an area variance of 15 feet, providing that there is adequate parking and will be no backing out onto the highway. All in favor. So carried.
A motion was made to adjourn by Tom Jantzen, seconded by Jennifer Phillips at 9:20 P.M.
