PUBLIC HEARINGS
The Clermont Planning Board held two public hearings on Wednesday, September 12, 2012 at 7:30 P.M. at the Town Hall. Those in attendance were Chairman Laurence Saulpaugh, Clayton Andrus, Brenda Case, Robert Queirolo, Aldo Dusman and Jennifer Phillips. Thomas Jantzen was absent.
Also present were Bob McCarthy, Phil Massaro, Robert Zimmerman, Robert Desmond, Judith Neary, Bea Banks, Randy Bloom, George Schmitt, Town Engineer and Andy Howard, Town Attorney.
A motion was made to approve the minutes by Jennifer Phillips, seconded by Clayton Andrus. All in favor. So carried.
A motion was made to close the regular meeting and open the public hearings by Clayton Andrus, seconded by Robert Queirolo. All in favor. So carried.
GEORGE SAULPAUGH & SONS/CLERMONT CEMETERY SOCIETY- Tax map ID#181.3-1-6.1 and 181.3-1-2
George W. Saulpaugh & Sons proposed annexing .47 acres to the Town (Tax map ID#181.3-1-4) on the south boundary from approximately 2.58 acres The Cemetery Society proposed annexing .007 acres to the Town (Tax map ID# 181.3-1-4) on the northwestern corner of the town’s property. Mr. Zimmerman stated that the corners have monuments in place. Certified letters were sent and all but one was received back from Paul Morano. Mr. Zimmerman provided three deed descriptions to cover these boundary line changes. He is acting for Saulpaugh’s and the Cemetery Society. Beatrice Banks, who is an adjoining landowner, said that a monument was removed at the corner of her property and the Cemetery property and replaced with a monument painted white. She also noticed that the corner was regraded. She was upset that no one had notified her before doing this. She feels that they would have had to go on her property to do this. Mr. Zimmerman did not know of this, he stated that the Town put in the roadway. Chairman Saulpaugh will talk to the highway superintendent and get back to her. There was no one else to speak for or against the boundary line change.
A motion was made to close the public hearing by Clayton Andrus and open the regular meeting, seconded by Brenda Case. All in favor. So carried.
A motion was made to declare a negative declaration by Brenda Case, seconded by Jennifer Phillips. All in favor. So carried.
A motion was made to approve the lot line adjustment as presented by Mr. Zimmerman for George W. Saulpaugh & Sons and the Clermont Cemetery Society by Jennifer Phillips, seconded by Clayton Andrus. All in favor. So carried.
FAY WERNER: 382 Nevis Road – Tax Map ID#191-1-1-19.1
Mrs. Werner, represented by Bob McCarthy, is proposing to subdivide 2 acres from 100 acres on Nevis Road at the southernmost section of the property. Certified letters were sent and receipts were submitted. Mr. McCarthy currently lives on site and there is a septic system and will be using the same. The well is currently shared but he will be putting in a well in the northeast corner of the property. There is overhead electric on the parcel. There were no comments for or against from anyone present.
A motion was made to close the public hearing and open the regular meeting by Jennifer Phillips, seconded by Brenda Case. All in favor. So carried.
A motion was made to declare a negative declaration by Clayton Andrus, seconded by Brenda Case. All in favor. So carried.
A motion was made to approve this subdivision as presented by Jennifer Phillips, seconded by Brenda Case. All in favor. So carried.
REGULAR MEETING
CARMELITES: 600 WOODS ROAD – Tax Map #179-1-69. Bill Clark represented the Carmelites Sisters in their proposal for a building on the Carmelites site for a memorial chapel, which will be open to the public. This will be the Memorial to Mother Angeline Center. The application is for a site plan review. The engineer for the Carmelites should prepare a short form EAF based on the footprint of the proposal. A site review will be held on Thursday, September 20th at 5:00 P.M. Board members should meet at the town hall.
RANDY BLOOM: Langridge Road – Tax Map ID#201.-1-26.111
Ms. Bloom is proposing subdividing a lot off of her property on Langridge Road, a dead end off Pleasantvale Road. She owns 144 acres and would be selling approximately half of the 144 acres for a house on the southeast corner at the end of the farm road. The access would be off the Town owned road, prior to the deeded turnaround and she would give them 50 feet off the town road. There was discussion as to whether this would become three parcels because her remaining land would end up separated by the town road. Our attorney explained that she could do that or she could have the deed description keep it as one parcel. It was suggested that she talk to the Assessor about how this subdivision could or would affect her tax situation.
MARY JANE FUCHS: 925 County Route 6 – Tax Map ID#191-00-01-32.1
Mr. Zimmerman represented Mrs.Fuchs in the subdivision of 1.58 acres from approximately 90 acres, which was separated by Cedar Hill Road but deeded as one property. There was a public hearing held on this subdivision on October 12, 2011 but maps were never stamped until there was an agreement on the use of the existing well, which is situated on another parcel. It was suggested that all parties involved should sign the map, Mary Jane Fuchs, Mary Theresa Fuchs and Gerri White. The map is approved with the stipulation that the map is signed by all parties on a motion made by Jennifer Phillips, seconded by Clayton Andrus. All in favor. So carried..
Bob Desmond asked for a clarification on the road separating lots from our town attorney. Andy Howard explained that if she wants to make three parcels it is at her peril.
Aldo Dusman asked if a homeowner owns to the center of a town road and there is an accident is the homeowner responsible. Andy Howard said no.
A motion was made to adjourn at 8:50 PM by Jennifer Phillips, seconded by Brenda Case. All in favor. So carried.
