Regular meeting of the ZBA on July 25, 2012

Members attending: Charlie Larsen, Chairman, Luke, Peter, and Tamera Connolly, secretary

Charlie opens the meeting at 7:36 pm. The meeting starts with a salute to the flag.

Charlie can not accept the minutes as presented as there is no one to second a motion.

New business:

Ray Tousey: The winery wants to renovate the building by changing the colors and the signing. The original sign will stay with a new name (no longer would be called Blue Roof Market) they want to add a sign to the side of the building. The entire building would be for the winery. The original sign would have hours of operations, website etc. Ray is explaining what he wants to do and the board will determine if an application will be needed.

Charlie suggests that they may need a variance for the change in the size of the business in ratio to the sign size. Peter thinks that if the sign size is exceeded that is the only concern. It is still an agriculture building. Peter agrees with Charlie’s recommendation. Tami provides Ray with an application. He will see John F. to discuss what is needed to be within regulation.

Dr. and Mrs. Teubl: They present the board with their application that they filled out. Charlie is going to X out the pages that do not apply. They did already go to the planning board and there was a site visit. They sent him to Jim Potts to review the plan. That plan is on Mary Helen Shannon’s desk. There needs to be a complete list of land owners from the town list. The fee for the ZBA permit is listed on the chart of fees. There is a form that the secretary sends out, so Tami will handle that. This will go to neighbors that are agricultural (farm land). This is in addition to the letter the applicant sends out to all surrounding neighbors. They will pay the application fee tonight of $100, a check is accepted. The public hearing will be held by the ZBA. We cannot speak about what the Planning board will want to do. The board reviews the application for completeness. Charlie asks for a motion to accept the application. Luke makes a motion, Pete seconds it and all are in favor so the application is accepted.  We go through the SEQRA form and complete it. Charlie asks for a motion to accept the environmental assessment form and it is second by Luke, all is in favor. Charlie asks for a motion that we accept lead agency. Luke makes a motion and Pete seconds, all are in favor. There will be a public hearing on August 22, 2012 at 7:30 pm.

Next item of business is a letter of complaint that was mailed to the ZBA. Charlie wants Tami to draft a letter explaining the role of the ZBA and also a copy of an application. The ZBA is an appeal board and not an enforcement agency. If he wishes to request an interpretation of the zoning board laws, you can complete the application and submit it to the board. A copy of the letter sent and the letter received should go to the town supervisor. Charlie request’s that Tami writes a letter in response to this letter

and a copy of the application. Peter makes the motion, Luke seconds it. All are in favor and the motion is carried.

 Old business:

Charlie asks if there is any other business. There is none. Charlie asks for a motion to adjourn the meeting at 8:24 pm. Pete makes a motion to adjourn the meeting, Luke seconds it. All are in favor and the motion is carried. Meeting is adjourned at 8:24 pm.
