CLERMONT PLANNING BOARD
NOVEMBER 14, 2012
The Clermont Planning Board held its regular meeting on Wednesday, November 14, 2012 at 7:30 P.M. at the Town Hall. Those in attendance were Chairman Laurence Saulpaugh, Clayton Andrus, Robert Queirolo, Thomas Jantzen, Aldo Dusman, Brenda Case and Jennifer Phillips. Also present was Robert Desmond, George Schmitt, Town Engineer, Andy Howard, Town Attorney, Randy Bloom and Mark Graminski, Surveyor.
A motion was made by Clayton Andrus, seconded by Tom Jantzen to approve the October minutes. All in favor. So carried.
RANDY BLOOM: 78 Langridge Road, Tax Map ID#201-1-26.111 – Ms. Bloom and
Mark Graminski, surveyor representing Ms. Bloom, came before the board. Ms. Bloom is proposing a subdivision of 144 acres into two parcels, consisting of 58.88 acres with existing structures and parcel #2 85.71 acres for a proposed single family residence.
She would like to keep property on both sides of Langridge Road, her residence and studio on one side and the rest on the other side will comprise 58 acres. She would like to keep them as one parcel, split by the town road. She may possibly want to combine at a future time with other lots that she retains. The new parcel has fifty feet of frontage on Langridge Road. There is a small piece of Army Corp of Engineers wetland, which he has already sent for a wetland delineator. They would require placing a box culvert in the stream. This is a nationwide permit, which is for single family residences. This would be a disturbance of less than one tenth of an acre. The intent is for the land to remain in agriculture.
Board members asked if this would now be considered a major subdivision, as Ms. Bloom had previously subdivided four lots from this parcel. Andy Howard explained that typically there is five-year period where any subdivisions are ‘grandfathered in’. There is a look back period but if the town does have this in their subdivision, then the five years applies. He will look at our subdivision regulations to make a determination. Under state law, the municipality has jurisdiction over subdivision. Mr. Graminski asked if this is determined to be a major subdivision, would the board be accepting of waivers to certain things. The response was yes, they would be.
Mr. Graminski is in the process of doing the boundary survey. Tom Jantzen asked about the utilities. Mr. Graminski explained that the owners would have to install utilities, but he will show the existing utilities on the map. He is not sure if he can get the Columbia County Health Department to come out now for the septic test, and asked if a certification would be okay. It is thought that the County would still be doing tests.
The applicant should bring in maps, health department approval, driveway permit from the town for next month and we will set the public hearing for January. The meeting is December 12th at 7:30 P.M.
Raymond Tousey: Received a letter from ZBA that a use variance was approved for a sign for Tousey Winery at Route 9 and County Route 6.
There was discussion on lots, which are naturally subdivided by a road and the number of lots on a dead end.
A motion was made by Clayton Andrus to adjourn, seconded by Thomas Jantzen at 8:50 P.M.
