Regular meeting of the ZBA on December 26, 2012

Members attending: Hank Himelright, Chairman, Luke, and Chris

The meeting was called to order at 7:30 pm.

A motion was made by Chris and second by Luke to open the Public Hearing on the application for a Special Permit related to yard variances on parcel 191.4-1-6 related to a building permit application 34.12 otherwise known as the Cahill residence at 164 Nevis Road and a concurrent hearing on the determination of SEQR review. All are in favor. The Hearing is opened.

Mr. Cahill sent out notices by certified mail return receipt requested to 16 abutting neighbors. He presented to the board 14 delivered and had receipts that the other two had been sent. No interested parties were present at the Public Hearing.

A motion is made to close the Public Hearing on the Special Permit and SEQR review. The motion was made by Chris and second by Luke. All are n favor and the Public Hearing is closed.

Discussion and review of the SEQR application is done that had been submitted by Mr. Cahill. A motion was made by Chris and second by Luke for a negative declaration for SEQR. All are in favor and the motion is carried.

Motion made by Luke and second by Hank to approve the application. All are in favor on the role call vote. The motion is carried.

The chairman requests the secretary to publish a schedule of application night assignments for all board members.

A motion to adjourn the meeting is made by Luke and second by Chris to close the meeting. All are in favor. The motion is carried and the meeting is adjourned.
