CLERMONT PLANNING BOARD
FEBRUARY 13, 2013
The Clermont Planning Board held its regular meeting on Wednesday, February 13, 2013 at 7:30 P.M. Those present were Chairman Laurence Saulpaugh, Clayton Andrus, Jennifer Phillips, Thomas Jantzen, Robert Queirolo, George Schmitt, Town Engineer, Erin Moore of Clark Engineering, Bill Clark of the Carmelites and Robert Desmond.
MINUTES: A motion was made by Clayton Andrus to accept the minutes of the January meeting, seconded by Tom Jantzen. All in favor. So carried.
A motion was made by Jennifer Phillips to close the regular meeting and open the public hearing on the Carmelite Sisters for the Aged and Infirmed site plan application, seconded by Tom Jantzen. All in favor. So carried.
PUBLIC HEARING:
Carmelite Sisters for the Aged and Infirmed – 600 Woods Road, Tax Map ID#179-1-69
Erin Moore, PE of Clark Engineering and Bill Clark of the Carmelites were present for the applicants. There was no one from the public to speak for or against this project.
Ms. Moore did speak to Mr. Maloney, a neighbor, and he did not express any concerns about the project. She did not bring the return receipts from the mailings but will send them out tomorrow.
Ms. Moore said that the Health Department has some minor comments and they have been addressed. She also explained that there is a very complete water treatment system at the site but the Health Department has no paperwork on it. They must complete water tests for a public water system because this will be the fifth hookup to the system. Tests have been done on all three wells on the property, which have very good output. There was further discussion on what is required by the Health Department. There were no further comments from the Board.
A motion was made to close the public hearing and open the regular meeting by Clayton Andrus, seconded by Tom Jantzen. All in favor. So carried.
SEQRA: After reviewing the SEQRA a motion was made to declare a negative declaration by Clayton Andrus, seconded by Tom Jantzen. All in favor. So carried.
The Columbia County Planning Board found that there was no significant county wide or intercommunity impact with this project.
A motion was made by Clayton Andrus to approve the site plan application on the condition that approval from the Columbia County Health Department is received, seconded by Jennifer Phillips. All in favor. So carried.
Bob Desmond is reviewing the section in the zoning ordinance on the Mining, Removal and Filling of Lands on page 47 and 48 and is seeking input from the Planning Board. In this section there are exceptions for earth removal which allow removal of soil, loam, sand, clay, barrow, gravel or stone incidental to building construction when there is a building permit lawfully issued. There are no exceptions for the homeowner for filling properties with even a load of stone or gravel for the driveway or other fill. There were suggestions of using yardage instead of tons when setting a limit, determining what constitutes clean fill and including septic systems in the allowed uses for bringing in fill.
Clayton pointed out that homeowners are building berms along their property lines for planting where areas are wet. Bob will be having out Town Attorney and Engineer review the suggestions.
A motion was made to adjourn by Jennifer Phillips, seconded by Tom Jantzen at 8:50 P.M.
