CLERMONT PLANNING BOARD
MARCH 12, 2014
The Clermont Planning Board held their regular meeting on Wednesday, March 12, 2014 at 7:30 P.M. Those present were Chairman Laurence Saulpaugh, Jennifer Phillips, Robert Queirolo, Clayton Andrus, Thomas Jantzen, Mary Howard and Aldo Dusman.
Others present were Robert Desmond, Raymond Tousey, Dan Russell representing Donna and Gregory Fingar, Kris Gildersleeve, Andy Howard, Town Attorney and George Schmitt, Town Engineer.
Chairman Saulpaugh opened the meeting.
MINUTES: A motion was made by Tom Jantzen, seconded by Clayton Andrus to approve the minutes of the February meeting. All in favor. So carried.
A motion was made by Clayton Andrus, seconded by Jennifer Phillips to close the regular meeting and open the public hearing on the boundary line change of Donna and Gregory Fingar.
FINGAR, GREGORY AND DONNA: Mill Road – Tax Map ID#180.-2-5.2 and #180.-2-54: Dan Russell of Crawford & Associates represented the Fingars in a boundary line change between two parcels on Mill Road. The purpose is to straighten the boundary line between the two parcels. The existing acreage is 3.00 acres and 2.9 acres. This adjustment will reduce the 3-acre parcel to 2.99 and increase the 2.9-acre parcel to 2.94 acres. There were no objections to this project and no questions from the board. A motion was made by Clayton Andrus to close the public hearing and open the meeting, seconded by Mary Howard.
SEQRA Review: The application was reviewed and a motion was made by Jennifer Phillips, seconded by Tom Jantzen to declare a negative declaration. All in favor. So carried.
A motion was made by Clayton Andrus, seconded by Tom Jantzen to accept the boundary line change as presented. All in favor. So carried.
Ray Tousey: 1783 Route 9 – Tax Map ID#181.3-1-6.110: Mr. Tousey purchased two acres adjoining his residence with an old barn with access from Route 9. The property has mostly been used by the Town for parking at events. He would like to use the barn, which is called "The Tin Barn" for events. The broadest use he could find in the zoning ordinance is for a convention center, defined as a facility used for the holding of conventions, seminars, workshops or similar activities, including dining and lodging facilities for the use of participants, as well as compatible accessory facilities such as recreation, administrative, maintenance, storage and parking. The building is 30 x 40 with a concrete floor. He wants to put in power, water and septic and use the barn for purposes such as graduations, weddings, the Easter Egg hunt and Village Green. He would maintain the property.
He would ask the Town to list him on the insurance policy. The Town’s BBQ pit could be rented also for these events. He would also put up a courtesy fence on the south side.
Parking was discussed, but Mr. Tousey would not want to put in blacktop, but leave it green. He has contacted Michael DeRuzzio at the Health department and they discussed his ideas for uses. George Schmitt said that the health department would want to know how many times it would be used, how many people will be in it. The septic would have to be designed by an engineer based on what the use is. The site plan should specify certain restrictions, such as whether or not it will be catered events only, hours of operations, lighting, parking, etc. Mr. Schmitt told Mr.Tousey that he should decide how it is going to be used. The town has to be aware of what it is that you want to do because approval will be based on that use. If doing one or two events a year you might want to go with portable toilets rather than a septic system. Also, the state code would have the chart, which would tell you how much square footage for each person depending on the use.
Jennifer Phillips said it should be set up so that the end expectations are reached. It sounds like a wonderful idea but Mr. Tousey would have to narrow down what uses he wants for the building.
Mr. Tousey submitted an application for a convention center and will return after further review.
A motion was made to adjourn by Jennifer Phillips, seconded by Robert Queirolo to adjourn at 8:35 P.M.
